A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,FOR EXECUTION OF A DRAINAGE AND
TEMPORARY CONSTRUCTION EASEMENT LOCATED NORTH AND WEST OF
DIRTWATER SPRINGS RESTAURANT;AND DECLARING AN EMERGENCY
WHEREAS,the City of Apache Junction is preparing to improve a
drainage canal in order to improve stormwater flows through the city;
and
WHEREAS,said improvement will require the City of Apache Junction
to obtain a drainage and temporary construction easement,as more fully
set forth in the attachment.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of
Apache Junction,Arizona,as follows:
Section 1.The Mayor and City Council consider i t necessary and
declare their intent to appropriate funds for the purpose of improving
the drainage canal and to obtain a temporary construction easement,and
desire to maintain such canal in perpetuity,in and to the premises
located in the City of Apache Junction,Pinal County,Arizona,and more
fully described and depicted in the attachment in Exhibits "A"and "B."
Section 2.The City Manager is hereby authorized to cause written
notice of the passage of this resolution to be served upon the owners
and persons in possession or having an interest of record in the above-
described property.This notice shall be served according to Arizona
law.
Section 3.This resolution is hereby declared to be an emergency
necessary for the immediate preservation of the public health,safety
and welfare.This prompt improvement of the drainage canal is necessary
in order to improve stormwater flows.Therefore,this resolution shall
go into immediate effect.
