RESOLUTION NO.98-13
A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,AUTHORIZING THE CREATION
OF A TWENTY-EIGHT FOOT (28')WIDE PRIVATE ACCESS
EASEMENT PURSUANT TO SECTION 20.0108 PRIVATE ACCESS
WAY STANDARDS OF THE CITY OF APACHE JUNCTION.ARIZONA.
ZONING ORDINANCE IN CASE PA -1-98,FOR THE PURPOSE OF
PROVIDING LEGAL ACCESS TO CERTAIN TH/PD (TRAILER
HOMESITES BY PLANNED DEVELOPMENT)-ZONED PARCELS
DESCRIBED HEREIN.
WHEREAS,A perpetual Private Access Easement described as
The South 28 feet of the West 428 feet of the North
half of the South half of the Northwest quarter of the
Southwest quarter of the Northwest quarter of Section
17,Township 1 North,Range Eight East of the Gila and
Salt River Base and Meridian,Apache Junction,Pinal
County,Arizona;EXCEPT for the West 50 feet thereof;
has been requested in Case PA -1-98,and as was stipulated as a condition of
approval of a major planned development amendment,in case PZ-32-97 (Ordinance
No.1026);and
WHEREAS,said Private Access Easement is for the benefit of
providing ingress and egress for the parcels described as follows:
PARCEL "A":The North half of the South half of the
Northwest quarter of the Southwest quarter of the
Northwest quarter of Section 17,Township One North,
Range Eight East of the Gila and Salt River Base and
Meridian,Apache Junction,Pinal County,Arizona;
EXCEPT for the West 400 feet thereof;and
PARCEL "B":The East 175 feet of the West 400 feet of
the North half of the South half of the Northwest
quarter of the Southwest quarter of the Northwest
quarter of Section 17,Township One North,Range Eight
East of the Gila and Salt River Base and Meridian,
Apache Junction,Pinal County,Arizona;and

PARCEL "C":The East 175 feet of the West 225 feet of
the North half of the South half of the Northwest
quarter of the Southwest quarter of the Northwest
quarter of Section 17,Township One North,Range Eight
East of the Gila and Salt River Base and Meridian,
Apache Junction,Pinal County,Arizona;and
WHEREAS,the creation of the Private Access Easement is necessary
to provide legal access to the above described parcels;and
WHEREAS,the City of Apache Junction Planning and Zoning
Commission did on January 27,1998,recommend approval of the Private Access
Easement,as part of a major planned development amendment request;and
WHEREAS,the City of Apache Junction City Council did on February
17,1998,approve said major planned development amendment,case PZ-32-97
(Ordinance No.1026),including a condition requiring a Private Access
Easement;and
WHEREAS,satisfactory evidence has been received to indicate that
the requested Private Access Easement does not present a potential hazard to
vehicular and/or pedestrian traffic;and
WHEREAS,the requested Private Access Easement would not be
detrimental to the public health,safety and welfare.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of
the City of Apache Junction,Arizona,that the Private Access Easement,as
described above,be approved subject to the following condition:
1.The full length and width of the Private Access Easement shall be
paved according to the requirements of the City Engineer.

JUNCTION,ARIZONA,THIS 5TH DAY OF MAY ,1998.
