HomeMy WebLinkAboutRES 98-15RESOLUTION NO.98-15 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,FINDING THE EXISTENCE OF AREAS WITHIN THE CORPORATE LIMITS OF THE CITY OF APACHE JUNCTION THAT QUALIFY FOR REDEVELOPMENT AS DEFINED BY ARIZONA REVISED STATUTES,TITLE 36,CHAPTER 12,ARTICLE 3. WHEREAS,Title 36,Chapter 12,Article 3,of the Arizona Revised Statutes Annotated ("A.R.S.") provide for redevelopment of certain areas within municipalities;and WHEREAS,certain findings are required to be made by the local governing body of a municipality prior to the exercise of the powers granted by A.R.S.Title 36,Chapter 12,Article 3;and WHEREAS,the majority of the residential and nonresidential structures within the boundaries of the area described by the legal description,as found in Exhibit One,and map,as found in Exhibit Two,and incorporated as part of this resolution meet the criteria for substandard as defined by A.R.S.Title 36,Chapter 12,Article 3;and WHEREAS.diversity of ownership within the described area forestalls the assemblage of lots into parcels suitable for redevelopment:and WHEREAS,the platting of said lots within the described mapped is minimal:and WHEREAS,the combination of the above -mentioned factors causes the following effect: 1.Substantially impairs the economic growth of the central business area of the City of Apache Junction by negatively impacting the orderly expansion of the area and limits job opportunities in the area; 2.Discourages development of housing facilities by preventing the redevelopment of a beneficial and usable combination of new units; 3.Constitutes an economic and social liability and stifles redevelopment; and RESOLUTION NO.98-15 PAGE 1 OF 5 WHEREAS,the redevelopment of such area is necessary in the interest of public health,safety,morals,or welfare of the residents of the City of Apache Junction. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA AS FOLLOWS: Section 1.That an area by definition of "Redevelopment Area" as defined by Arizona Revised Statutes Title 36,Chapter 12,Article 3,Section 1471.14(a&b) is hereby found to exist within the corporate limits of the City of Apache Junction and which constitutes a condition that is injurious to the public health,safety,morals or welfare of the residents of the City of Apache Junction.Such area is legally described in Exhibit One and delineated by the map in Exhibit Two,both of which are attached hereto and made a part hereof by reference.Said area shall be referred to as the Crossroads Redevelopment Area. Section 2.That the redevelopment of the Crossroads Redevelopment Area is necessary in the interest of the public health,safety,morals or welfare of the residents of the City of Apache Junction. Section 3.The Crossroads Redevelopment Area is hereby declared to be in need of redevelopment in compliance with provisions of A.R.S..Title 36,Chapter 12,Article 3.
