HomeMy WebLinkAboutRES 99-40RESOLUTION NO.99-40 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,APPROVING PRELIMINARY SUBDIVISION PLAT,CASE NO.SD- 99 -01,LOST DUTCHMAN GARDENS,A.L.C.BUILDERS,QUEEN CREEK,ARIZONA. WHEREAS,the subdivider in case SD -99-01 proposes to subdivide 10 acres at the southwest corner of Lost Dutchman Boulevard and Warner Drive,into 35 single family residential lots pursuant to Arizona Revised Statutes Annotated §9-463 et seq.,and pursuant to the Apache Junction City Code (hereinafter "A.J.C.C.),Volume II,Land Development Code (hereinafter "L.D.C."),Chapter 2,Subdivision Regulations;and WHEREAS,the Apache Junction Planning and Zoning Commission held a public hearing regarding SD -99-01 on May 25,1999 and recommended approval of SD -99-01 by a vote of 6-0;and WHEREAS,this Council finds this proposed subdivision to be consistent with the Medium Density designation of the Apache Junction General Plan;and WHEREAS,this Council finds this proposed subdivision to be in compliance with the A.J.C.C.,Vol.II,L.D.C.,Chapter 2,Subdivision Regulations:and WHEREAS,this Council finds that the stipulations required for this subdivision are necessary for sound and orderly community development,for preservations of community values and for the promotion of the general health, safety,convenience,and welfare of the citizens of Apache Junction. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that: Said preliminary subdivision plat,SD -99-01,for Lost Dutchman Gardens Subdivision be conditionally approved subject to the following stipulations and conditions: 1.The Final Plat is to be in substantial conformance with the approved preliminary plat. 2.All requirements of the City of Apache Junction,and associated reviewing agencies,shall be completely satisfied. 3.All construction associated with this proposal shall comply with the Uniform Building Code,and all other applicable RESOLUTION NO.99-40 PAGE ONE OF TWO codes and standards as adopted by the City of Apache Junction. 4.All heating,ventilation,air conditioning (HVAC)units are to be ground -set,and roof -mounted units are not permitted.Said HVAC units shall be a minimum of 5 feet from any interior side property line. Should an HVAC units be placed on the street -side of a corner lot the units shall meet the minimum required setback of 15 feet. 5.Roofing material shall be,as a minimum,asphalt laminated shingles and the color palate shall be consistent with the samples presented by the developer,a copy of which is on file at the Planning Division of the Development Services Department. 6.A Street -light Improvement District shall be established as part of the Final Plat process. 7.Location of fire hydrants shall be indicated on the Final Plat,in accordance with all Uniform Fire Code regulations and any other City regulations.
