A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,APPROVING PRELIMINARY SUBDIVISION PLAT,CASE NO.SD -04-99,TOMAHAWK,BY
ROGER & SYBIL FERGUSON,REPRESENTED BY CLYDE BARNEY
WHEREAS,the subdivider in case SD -04-99 proposes to subdivide forty -gross
acres in the Southwest Quarter of Section 34,T.1 N.,R.8 E.,Gila and Salt
River Base and Meridian,Pinal County,Arizona,into 180 residential lots
pursuant to Arizona Revised Statutes Annotated ("A.R.S..")§ 9-463 et seq.,and
pursuant to the Apache Junction Subdivision Regulations set forth in the Apache
Junction City Code ("A.J.C.C."),Volume II,Land Development Code ("L.D.C"),
Chapter 2:and
WHEREAS,the Apache Junction Planning and Zoning Commission held a special
meeting regarding SD -04-99 on November 9,1999 and recommended to continue Case
SD -04-99 to their next regular meeting by the Apache Junction Planning and Zoning
Commission on November 23,1999 by a vote of 4 to 2:and
WHEREAS,the Apache Junction Planning and Zoning Commission held a public
hearing regarding SD -04-99 on November 23,1999 and recommended denial of the
preliminary plat by a vote of 4 to 0:and
WHEREAS,the Apache Junction City Council held a public hearing regarding
SD -04-99 on January 4,2000 and decided to continue Case SD -04-99 to their next
regular meeting by the Apache Junction City Council on February 1,2000 by a vote
of 7 to 0:and
WHEREAS,the Mayor and City Council finds this proposed preliminary plat to
be in compliance with the Apache Junction City Code ('A.J.C.C"),Volume II,Land
Development Code ("L.D.C"),Chapter 1,Zoning Ordinance pursuant to Ordinance
Number 1108 (companion case PZ-11-99)which amended the Zoning District Map.City
of Apache Junction Arizona,and changed the zoning district classification from
TH (Trailer Homesite)to CR-3/PD (Single Family Residence Zone by Planned
Development):and
WHEREAS.the Mayor and City Council finds this proposed preliminary plat to
not be in conflict with Resolution Number 99-63 (companion case GPA-02-99)which
amended the General Plan Map,City of Apache Junction,Arizona,and changed the
General Plan Designation from C (Commercial)to MD (Residential Medium Density):
and
WHEREAS,the Mayor and City Council finds this proposed preliminary plat to

be in compliance with the Apache Junction City Code ('A.J.C.C"),Volume II,Land
Development Code ("L.D.C"),Chapter 1,Zoning Ordinance:and
WHEREAS,the Mayor and City Council finds that the stipulations required
for this subdivision are necessary for sound and orderly community development,
for preservation of community values and for the promotion of the general health,
safety,convenience,and welfare of the citizens of Apache Junction.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of
Apache Junction,Arizona,that:
Said preliminary subdivision plat,SD -04-99,Tomahawk,be conditionally
approved subject to the following stipulations and conditions:
1)All conditions of Ordinance No.1108,approving the rezoning from TH
(Trailer Homesite)to CR-3/PD (Single Family Residence Zone by
Planned Development),that are in effect shall apply.
2)The retention/recreational tracts indicated as Tracts B,C,D,E,F
and G on the Preliminary Plat received by the Planning Division on
January 31.2000,on file with the Planning Division of the Apache
Junction Development Services Department in Case File No.SD -04-99,
must be maintained by a private -homeowner's association,or the
developer or the property owner until such a homeowner's association
is in place.
3)The subdivision shall be developed in compliance with the CR-3
District,and all other applicable codes and regulations,except as
modified by the Planned Development conditions of approval.
4)The property owner agrees to provide an amenity area equal to or
similar to that shown by the revised Conceptual Landscape Plan,dated
January 27,2000,on file with the Planning Division of the Apache
Junction Development Services Department in Case File No.SD -04-99.
