A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION.ARIZONA,APPROVING THE PRELIMINARY SUBDIVISION PLAT FOR
FRY'S NO.65 COMMERCIAL SUBDIVISION,CASE NO.SD -99-05.
WHEREAS.the subdivider in case SD -99-05 proposes to subdivide 16.18
acres at the Southeast corner of Phelps Drive and Apache Trail into 7
commercial lots pursuant to Arizona Revised Statutes Annotated §9-463 et seq.,
and pursuant to the Apache Junction City Code (hereinafter "A.J.C.C."),Vol.
II.Land Development Code (hereinafter "L.D.C."),Chapter 2,Subdivision
Regulations;and
WHEREAS,the Apache Junction Planning and Zoning Commission held a
public hearing regarding SD -99-05 on November 9,1999 and recommended approval
of the preliminary plat by a vote of 7 -0;and
WHEREAS,this Council finds this proposed subdivision to be consistent
with the Commercial designation of the 1987 Apache Junction General Plan and
Amendments thereto;and
WHEREAS.this Council finds this proposed subdivision to be in
compliance with the A.J.C.C.,Vol.II,L.D.C.,Chapter 1,Zoning Ordinance and
Chapter 2,Subdivision Regulations;and
WHEREAS,this Council finds the conditions of approval required for this
subdivision are necessary for sound and orderly community development,for
preservation of community values and for the promotion of the general health,
safety,convenience,and welfare of the citizens of Apache Junction.
1.The Final Plat shall substantially conform to the approved
Preliminary Plat.
NOW.THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that:

Said preliminary subdivision plat,SD -99-05,be approved.
PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,THIS 18TH DAY OF JANUARY 2000.
