A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,APPROVING THE FINAL SUBDIVISION PLAT LOST
DUTCHMAN GARDENS SUBDIVISION,CASE NO.SD -99-01,BY A.L.C.
BUILDERS,QUEEN CREEK.ARIZONA.
WHEREAS,the subdivider in case SD -99-01 proposes to subdivide 10.0
acres in the southwest corner of Lost Dutchman Boulevard and Warner Drive into
35 single family residential lots pursuant to Arizona Revised Statutes
Annotated §9.463 et seq.,and pursuant to the Apache Junction City Code
(hereinafter "A.J.C.C."),Vol.II,Land Development Code (hereinafter
"L.D.C."),Chapter 2,Subdivision Regulations;and
WHEREAS,the Apache Junction Planning and Zoning Commission held a
public hearing regarding SD-99-01on May 25,1999 and recommended approval of
the preliminary plat by a vote of 6 to 0:and
WHEREAS,the Apache Junction City Council held a public hearing
regarding the preliminary plat for SD -99-01 on June 25,1999,and approved
said preliminary plat per Resolution 99-40,by a vote of 7 to 0;and
WHEREAS,this Council finds this proposed subdivision to be consistent
with the Medium Density (1 to 6 dwelling units per acre)designation of the
1987 Apache Junction General Plan and Amendments thereto;and
WHEREAS,this Council finds this proposed subdivision to be in
compliance with the and the A.J.C.C..Vol.II,L.D.C.,Chapter 1,Zoning
Ordinance and Chapter 2,Subdivision Regulations;and
WHEREAS,this Council finds the proposed final plat for SD -99-01,Lost
Dutchman Gardens.to be in substantial compliance with the approved
preliminary plat.
NOW,THEREFORE.BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction.Arizona,that:
Said final subdivision plat.SD -99-01,which includes the on and off -site
improvements,landscape and amenity plans,be approved.
