A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,APPROVING GENERAL PLAN AMENDMENT GPA-99-02,A
REQUEST FOR A LAND USE REDESIGNATION FROM "C"(COMMERCIAL)AND
"IND"(BUSINESS PARK/INDUSTRIAL)TO "MD"(MEDIUM DENSITY
RESIDENTIAL/1 TO 6 DWELLING UNITS PER ACRE/CONVENTIONAL HOMES
ONLY),FOR A 40 GROSS ACRES PROPERTY LOCATED AT THE NORTHEAST
CORNER OF S.TOMAHAWK ROAD AND E.BASELINE AVENUE.
WHEREAS,the Apache Junction City Council did,on June 16,1987,adopt
the 1987 Apache Junction General Plan;and
WHEREAS,the Apache Junction Planning and Zoning Commission held a
public hearing regarding GPA-99-02 on October 26,1999;and
WHEREAS,the Apache Junction Planning and Zoning Commission recommended
approval of GPA-99-02 by a vote of 4 to 2;and
WHEREAS,this Council has complied with the requirements for the
preparation and adoption of a General Plan Amendment pursuant to Arizona
Revised Statutes Annotated Section 9-461.06;and
WHEREAS,this Council finds that the action taken on this General Plan
Amendment is necessary for sound and orderly community development,for
preservation of community values and for the promotion of the general health,
safety,convenience and welfare of the citizens of Apache Junction;and
WHEREAS,this Council makes the following Findings of Fact required by
Section D.1.6 of the 1987 Apache Junction General Plan to support the approval
of GPA-99-02:
1.The development pattern contained in the Land Use Plan inadequately
provides appropriate optional sites for the use proposed in the
amendment,insofar as large private tracts of land (not State lands)for
residential development at Medium Density are becoming scarce in the
City;
2.That the amendment constitutes an overall improvement to the General
Plan and is not solely for the good or benefit of a particular land

owner or owners at a particular point in time.The property owners in
this case are actually helping to resolve an incompatibility between the
General Plan and existing Zoning;
3.That the amendment will not adversely impact the community as a whole or
a portion of the community by:
a)Significantly altering acceptable existing land use patterns,
because other extensive residential uses already exist or have
been approved in the immediate area;
b)Requiring larger and more expensive improvements to roads,sewer
or water systems than are needed to support the prevailing land
uses and which,therefore,may impact development of other lands,
because the developer will provide and pay for all these
improvements;
c)Adversely impacting existing uses because of increased traffic on
existing systems,because the developer will actually be improving
the major arterials for the benefit of the whole neighborhood;or
d)Affecting the livability of the area or the health and safety of
the residents;
4.That the amendment is consistent with the overall intent of this General
Plan.In this case,the amendment is consistent and compatible with the
pattern of land uses which has evolved thus far in the area.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that:
GPA-99-02,a General Plan Amendment request to redesignate from
Commercial and Business Park/Industrial to Medium Density Residential,a 40-
acre property,be approved and adopted,for the following legally described
property:
The Southwest quarter of the Southwest quarter of Section 34,
Township I North,Range 8 East of the Gila and Salt River Base and
Meridian,Apache Junction,Pinal County,Arizona;
PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,THIS 1ST DAY OF FEBRuApv ,2000.
