A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,FOR EXECUTION OF A DEVELOPMENT AGREEMENT FOR
CONSTRUCTION OF A MASONRY WALL LOCATED IN ROCK SHADOWS
RECREATIONAL VEHICLE PARK;AND DECLARING AN EMERGENCY
WHEREAS,pursuant to Arizona Revised Statutes Annotated §9-500.05,a
municipality may by resolution enter into development agreements relating to
property within the municipality;and
WHEREAS,the City of Apache Junction is preparing to improve a drainage
canal in order to improve stormwater flows through the city;and
WHEREAS,in exchange for the City maintaining the drainage easement in
perpetuity,the Developer has agreed to construct and maintain at its sole
cost a six foot (6') masonry wall,as reflected in the attached agreement.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Apache
Junction,Arizona,as follows:
Section 1.The Mayor and City Council consider i t necessary to
construct the drainage easement and maintain said canal in perpetuity in
exchange for the Developer constructing the masonry wall.
Section 2.The City Manager is hereby authorized to cause written
notice of the passage of this resolution to be served upon the owners and
persons in possession or having an interest of record in the property
described in the attachment.This notice shall be served according to Arizona
law.
Section 3.This resolution is hereby declared to be an emergency
necessary for the immediate preservation of the public health,safety and
welfare.Therefore,this resolution shall go into immediate effect.
