A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,PURSUANT TO A.R.S.§28-7214 DECLARING THAT A PORTION OF A
DEDICATED RIGHT-OF-WAY IDENTIFIED AS 17TH AVENUE FROM VISTA ROAD TO
WICKIUP ROAD DESCRIBED IN ABANDONMENT CASE AB -97-02,IS NO LONGER
NECESSARY FOR PUBLIC ROADWAY AND ASSOCIATED PURPOSES AND IS HEREBY
VACATED.
WHEREAS,the requested vacation is a dedicated right-of-way for public
roadway and associated purposes over a parcel of real property described in
Docket 1397 Page 334,of records of Pinal County,Arizona;and
WHEREAS,the City has determined that it will not presently need nor will
it need in the future a portion of said right-of-way more particularly described
as follows:
The North 33'of the East 165'of the South half of the Northeast quarter of the
Northwest quarter of the Southwest quarter of Section 27,Township 1 North,
Range 8 East of the Gila and Salt River Base and Meridian,Pinal County, Arizona;
Except the East 33'thereof;and
A portion of the East 165'of the South half of the Northeast quarter of the
Northwest quarter of the Southwest quarter,Section 27.Township 1 North,Range
8 East of the Salt River Base and Meridian,Pinal County,Arizona:further
described as follows:
Commencing at the Northeast corner of the South half of the Northeast quarter of
the Northwest quarter of the Southwest quarter of Section 27:
Thence West along the North line of the South half ,a distance of 53 to a
point;
Thence South along a line parallel to and 53'distant to the East line of the
South half,a distance of 33'to the TRUE POINT OF BEGINNING;
Thence East along a line parallel to and 33'distant to the North line of the
South half,a distance of 20'to a point:
Thence South along a line parallel to and 33'distant to the East line of the
South half,a distance of 20'to a point:
Thence proceeding in a Northwesterly direction to the TRUE POINT OF BEGINNING.

WHEREAS,if the vacation is approved,such action will not leave a parcel
in separate ownership without access to an established public roadway connecting
such lands with another public roadway,or have access by a Federally Patented
Easement which may in the future be developed;and
WHEREAS,the City Council of The City of Apache Junction,Arizona,finds
that said dedicated Right-of-way for public roadway and associated purposes as
described herein,is classified as a local street by the City of Apache Junction,
and is no longer necessary for public use as an street.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that the above -described dedication reserved for
public roadway and associated purposes is hereby vacated.
BE IT FURTHER RESOLVED that the vacation of the public roadway and
associated purposes does not eliminate the rights -of -way for any public utility
purposes.
