A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,APPROVING PRELIMINARY SUBDIVISION PLAT,CASE NO.SD -98-06,COYOTE
RUN,BY GENE WILSON.
WHEREAS,the subdivider in case SD -98-06 proposes to subdivide five
acres in the Northwest Quarter of Section 28,T.1 N.,R.8 E.,Gila and Salt
River Base and Meridian,Pinal County.Arizona,into 14 residential lots
pursuant to Arizona Revised Statutes Annotated ("A.R.S.")§ 9-463 et seq.,and
pursuant to the Apache Junction Subdivision Regulations set forth in the
Apache Junction City Code ("A.J.C.C."),Volume II,Land Development Code,
Chapter 2:and
WHEREAS,the Apache Junction Planning and Zoning Commission held a
public hearing regarding SD -98-06 on February 23,1999 and recommended
approval of the preliminary plat by a vote of 6 to 0:and
WHEREAS,the Mayor and City Council finds this proposed preliminary plat
to be in compliance with the Apache Junction City Code,Volume II,Land
Development Code,Chapter 1,Zoning Ordinance pursuant to Ordinance Number
1059 (companion case PZ-98-18)which amended the Zoning District Map,City of
Apache Junction Arizona,and changed the zoning district classification from
CR-1 (Single Family Residence Zone,residences on 20,000 -net square foot
minimum lots)to CR-2 (Single Family Residence Zone,residences on 11,000 -net
square foot minimum lots in approved subdivisions):and
WHEREAS,the Mayor and City Council finds this proposed preliminary plat
to not be in conflict with the Medium Density ("MD")designation of the Apache
Junction General Plan:and
WHEREAS,the Mayor and City Council finds this proposed preliminary plat
to be in compliance with the Apache Junction City Code,Volume II,Land
Development Code,Chapter 1,Zoning Ordinance:and
WHEREAS,the Mayor and City Council finds that the stipulations required
for this subdivision are necessary for sound and .orderly community
development,for preservation of community values and for the promotion of the
general health,safety.convenience,and welfare of the citizens of Apache
Junction.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that:

Said preliminary subdivision plat,SD -98-06,Coyote Run,be
conditionally approved subject to the following stipulations and conditions:
1)All outstanding conditions of Ordinance No.1059,approving the
rezoning from CR-1 to CR-2,that are still in effect shall apply
2)The subdivision shall be developed in compliance with all applicable
codes and regulations,including,but not limited to,installation of
the two fire hydrants as recommended by the Apache Junction Fire
District,in a letter dated December 21,1998,a copy which is on
file with the Planing Division of the Apache Junction Development
Services Department in Case File No.SD -98-06.
3)All retention basins and drainage easements shall be combined as part
of the adjacent residential lots,which include lot numbers 8,9,12,
13,and 14.Such areas shall be maintained by the property owners to
city standards,with such restriction set forth on the deeds to each
lot.The Final Plat shall also reflect that the retention basins and
drainage easements shall be maintained by the property owners of each
lot.

JUNCTION,ARIZONA,THIS 4TH DAY OF MAY ,1999.
