A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,APPROVING FINAL SUBDIVISION RE -PLAT,CASE NO.SD -98-02,SUNRISE RV
RESORT,TRACT C:WHICH IS ALSO A RE -PLAT AND RE -DESIGNATION OF USE FOR TRACT C
AS APPROVED BY CASE NO.SD -83-01,SUNRISE RV RESORT.
WHEREAS,the subdivider in case SD -98-02 proposes to re -plat,re-
designate,and subdivide 1.5 -net acres in the Northeast Quarter of Section 29,
T.1 N.,R.8 E.,Gila and Salt River Base and Meridian,Pinal County,
Arizona,into 17 residential lots pursuant to Arizona Revised Statutes
Annotated ("A.R.S.") §9-463 et seq..and pursuant to the Apache Junction
Subdivision Regulations set forth in the Apache Junction City Code
("A.J.C.C."),Volume II,Land Development Code.Chapter 2;and
WHEREAS,the Apache Junction Planning and Zoning Commission held a
public hearing regarding SD -98-02 on July 28,1998 and recommended approval of
the subdivision re -plat and re -designation of use for Tract C by a vote of 7
to 0:and
WHEREAS,the Mayor and City Council held a public hearing regarding SD-
98 -02 on September 1,1998,and recommended approval of the subdivision re-
plat and re -designation of use for Tract C by a vote of 3 to 2,with one
Councilman abstaining:and
WHEREAS,the Mayor and City Council finds this subdivision re -plat and
re -designation of use for Tract C to be in compliance with the Apache Junction
City Code,Volume II,Land Development Code,Article 19.Planned Development
Zoning District pursuant to Ordinance Number 1008 (companion case PZ-97-15)
which amended the final planned development plan for Tract C in Ordinance
Number 190 (companion case PZ-83-17)to allow seventeen (17)recreational
vehicle lots in the formerly designated common area:and
WHEREAS.the Mayor and City Council finds this proposed subdivision re-
plat and re -designation of use for Tract C to not be in conflict with the
Recreational Vehicle Park (-RVP")designation of the Apache Junction General
Plan:and
WHEREAS,the Mayor and City Council finds this proposed subdivision re-
plat and re -designation of use for Tract C to be in compliance with Apache
Junction City Code,Volume II.Land Development Code,Chapter 1,Zoning
Ordinance:and

WHEREAS.the Mayor and Council finds that the stipulations required for
this subdivision are necessary for sound and orderly community development,
for preservation of community values and for the promotion of the general
health,safety,convenience,and welfare of the citizens of Apache Junction.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that:
Said preliminary subdivision re -plat and re -designation of use for Tract
C,SD -98-02,Sunrise RV Resort,be conditionally approved subject to the
following stipulations and conditions:
1) All outstanding conditions of Resolution 98-24,which approved the
Preliminary Subdivision re -plat and re -designation of use for Tract C
as approved by Case No.SD -83-01 of Sunrise RV Resort that are still
in effect,shall apply.
2)The subdivision shall be developed in compliance with all applicable
codes and regulations,including,but not limited to,installation of
signage and devices as recommended by the Apache Junction Fire
District,in a letter dated March 26,1999,a copy which is on file
with the Planing Division of the Apache Junction Development Services
Department in Case File No.SD -98-02.
