HomeMy WebLinkAboutRES 99-28RESOLUTION NO.99-28 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THEvCITY i MACHE JUNCTION,ARIZONA,APPROVING GENERAL PLAN AMENDMENT GPA-98-02,A QUEST TO EXTEND THE C (COMMERCIAL)DESIGNATION ON A 10 -ACRE PRORpTY,WHICH EXISTS ON THE NORTH 5 ACRES OF THE PROPERTY,TO ENCO "SS ROUGHLY THE NORTH 4 ACRES OF THE SOUTH 5 ACRES OF SAID PROPER PRESENTLY DESIGNATED MD (MEDIUM DENSITY RESIDENTIAL/ CONVENTIFIL HOMES ONLY/1 TO 6 DWELLING UNITS PER ACRE),LOCATED AT THE SOU .EAST CORNER OF W.BROADWAY AVENUE AND S.SAN MARCOS DRIVE. WHEREAS,the Apke Junction City Council did,on June 16,1987,adopt the 1987 Apache Junctiot\General Plan:and WHEREAS,the Apache Nnction Planning and Zoning Commission held a public hearing regarding GPA 8-02 on March 9,1999:and WHEREAS,the Apache Junctitv Planning and Zoning Commission recommended denial of GPA-98-02 by a vote of 4\to 3:and N \WHEREAS,this Council has comp .ed with the requirements for the preparation and adoption of a General Nan Amendment pursuant to Arizona Revised Statutes Annotated Section 9-461 06:and WHEREAS,this Council finds that the 'tion taken on this General Plan Amendment is necessary for sound and orderly ommunity development,for preservation of community values and for the p'Pçmotion of the general health, safety,convenience and welfare of the citizens f Apache Junction:and WHEREAS,this Council makes the following FiAngs of Fact required by Section D.1.6 of the 1987 Apache Junction General Pla\to support the approval of GPA-98-02: 1.The development pattern contained in the Land Use P1 provides appropriate optional sites for the use propos amendment: inadequately in the 2.That the amendment constitutes an overall improvement to theNeneral Plan and is not solely for the good or benefit of a particulaNand owner or owners at a particular point in time: RESOLUTION NO.99-28 PAGE ONE OF THREE 3.That the amendment will not adversely impact the community as a whole or a portion of the community by: Significantly altering acceptable existing land use patterns; Requiring larger and more expensive improvements to roads,sewer or water systems than are needed to support the prevailing land Acs and which,therefore,may impact development of other lands; AdveAely impacting existing uses because of increased traffic on existid systems;or Affecting Xie livability of the area or the health and safety of the resided 4.That the amendment is\consistent with the overall intent of this General Plan. NOW,THEREFORE,BE IT RESONED by the Mayor and City Council of the City of Apache Junction,Arizona,that GPA-98-02,a General Plan Amend nt request to redesignate from Medium Density Residential to Commercial,a po ion of a 10 acre property.Le approved and adopted,for the following 1 ally described property: The North 480 feet of the South 660 fe of the West half of the West half of the Northwest quarter of th Northeast quarter of Section 29,Township 1 North,Range 8 Eas of the Gila and Salt River Base and Meridian,Apache Junction,P.al County,Arizona; PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF HE CITY OF APACHE JUNCTION,ARIZONA,THIS DAY OF ,1999'.
