Home My WebLink AboutRES 00-14RESOLUTION NO.00-14 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,APPROVING THE FINAL SUBDIVISION PLAT,CASE NO.SD -99-05,FRY'S NO.65 COMMERCIAL SUBDIVISION. WHEREAS,the subdivider in case SD -99-05 proposes to subdivide 16.18 acres at the Southeast corner of Phelps Drive and Apache Trail into seven commercial lots pursuant to Arizona Revised Statutes Annotated ("A.R.S.")§ 9-463 et seq., and pursuant to the Apache Junction City Code ("A.J.C.C."),Volume II.Land Development Code ("L.D.C"),Chapter 2,Subdivision Regulations;and WHEREAS,the Apache Junction Planning and Zoning Commission held a public hearing regarding SD -99-05 on November 9,1999 and recommended approval of the preliminary plat by a vote of 7 to 0;and WHEREAS,the Mayor and City Council held a public hearing regarding SD -99- 05 on January 18,2000 and recommended approval of the preliminary plat by a vote of 7 to 0;and WHEREAS,the Mayor and City Council finds this proposed Final Plat to be consistent with the ,Commercial designation of the 1987 Apache Junction General Plan and Amendments thereto;and WHEREAS,the Mayor and City Council finds this proposed Final Plat to be in compliance with the Apache Junction City Code,Volume II,Land Development Code, Chapter 1,Zoning Ordinance and Chapter 2,Subdivision Regulations:and WHEREAS,the Mayor and City Council finds the proposed Final Plat for SD- 99 -05,Fry's No.65 Commercial Subdivision,to be in substantial compliance with the approved preliminary plat. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that: 1.The Final Plat is hereby approved by the Mayor and City Council. Staff is directed pursuant to A.R.S.§9-463.01(J)to record the Final Plat with the Pinal County Recorder and to collect the Final Plat Recording Fee from the subdivider and remit such amount to the Pinal County Recorder.
