A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,APPROVING THE FINAL SUBDIVISION PLAT,CASE NO.SD -99-04,TOMAHAWK,BY
ROGER & SYBIL FERGUSON,REPRESENTED BY CLYDE BARNEY.
WHEREAS,the subdivider in case SD -99-04 proposes to subdivide forty -gross
acres in the Southwest Quarter of Section 34,T.1 N.,R.8 E.,Gila and Salt
River Base and Meridian,Pinal County.Arizona,into 179 residential lots
pursuant to Arizona Revised Statutes Annotated ("A.R.S.")§ 9-463 et seq.,and
pursuant to the Apache Junction Subdivision Regulations set forth in the Apache
Junction City Code ("A.J.C.C."),Volume II,Land Development Code ("L.D.C"),
Chapter 2:and
WHEREAS,the Apache Junction Planning and Zoning Commission held a special
meeting regarding SD -99-04 on November 9,1999 and recommended to continue Case
SD -99-04 to their next regular meeting by the Apache Junction Planning and Zoning
Commission on November 23,1999 by a vote of 4 to 2;and
WHEREAS,the Apache Junction Planning and Zoning Commission held a public
hearing regarding SD -99-04 on November 23,1999 and recommended denial of the
preliminary plat by a vote of 4 to 0:and
WHEREAS,the Apache Junction City Council held a public hearing regarding
SD -99-04 on January 4,2000 and decided to continue Case SD -99-04 to their next
regular meeting by the Apache Junction City Council on February 1,2000 by a vote
of 7 to 0:and
WHEREAS,the Mayor and City Council held a public hearing regarding SD -99-
04 on February 1,2000 and recommended approval of the preliminary plat by a vote
of 5 to 2:and
WHEREAS,the Mayor and City Council finds this proposed Final Plat to be
consistent with the Medium Density Residential designation of the Apache Junction
General Plan adopted on November 2,1999:and
WHEREAS,the Mayor and City Council finds this proposed Final Plat to be in
compliance with the Apache Junction City Code,Volume II,Land Development Code,
Chapter 1,Zoning Ordinance and Chapter 2,Subdivision Regulations;and

WHEREAS,the Mayor and City Council finds the proposed Final Plat for SD-
99 -04,Tomahawk,to be in substantial compliance with the approved preliminary
plat.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of
Apache Junction,Arizona,that:
1.The Final Plat is hereby approved by the Mayor and City Council.
2.Staff is directed pursuant to A.R.S.§9-463.01(J)to record the Final
Plat with the Pinal County Recorder and to collect the Final Plat
Recording Fee from the subdivider and remit such amount to the Pinal
County Recorder.
