A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION.
ARIZONA,AUTHORIZING THE CITY OF APACHE JUNCTION TO ENTER INTO A DEVELOPMENT
AGREEMENT WITH MCMILLAN MANUFACTURED HOME DEVELOPMENT.LC,AUTHORIZING THE MAYOR
AND STAFF TO TAKE ANY AND ALL STEPS NECESSARY TO ACCOMPLISH THE ABOVE.AND
DECLARING AN EMERGENCY.
WHEREAS,McMillan Manufactured Home Development,LC,("Owner")has an
interest in certain real property within the City of Apache Junction ("City");
and
WHEREAS,Owner and City wish to enter into a Development Agreement,
pursuant to Arizona Revised Statutes Annotated §§9-500.05 and 9-500.11:and
WHEREAS,the City has initiated a rezoning case on the property to change
the existing zoning from TH (Trailer Homesite)to C-2 (Local Commercial District)
as enabled by Arizona Revised Statutes Annotated §9-462.01(A)(1);and
WHEREAS,the City has initiated this change in zoning in order to have the
zoning on the property conform to and be consistent with City's 1999 General
Plan;and
WHEREAS,the Owner and City acknowledge that the development of the
property as a C-2 land use will have significant planning and economic benefits
to the City and Owner by increasing sales tax revenues,creating employment and
increasing the potential for increased property valuation.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA.AS FOLLOWS:
Section 1.The City of Apache Junction hereby approves the Development
Agreement with McMillan Manufactured Home Development.LC,as set forth in
Attachment "1".
Section 2.The Mayor and City staff are hereby authorized to execute the
attached Development Agreement and to take any and all steps deemed necessary to
accomplish the above.

Section 3.The immediate operation of the provisions of this Resolution is
necessary for the immediate preservation of the public peace,health or safety.
and that an emergency is hereby declared to exist;and this resolution shall be
in full force and effect from and after its passage,adoption and approval by the
Mayor and Council of the City of Apache Junction.
PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION.
