A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AUTHORIZING THE CREATION OF A
TWENTY-EIGHT FOOT (28')WIDE PRIVATE ACCESS WAY,IN
CASE PA -3-00 AND AS CONCEPTUALLY APPROVED IN CASE PZ-01-00
BY ORDINANCE NO.1123,FOR THE PURPOSE OF PROVIDING LEGAL
ACCESS TO CERTAIN PARCELS DESCRIBED HEREIN AND ZONED TH/PD
(TRAILER HOMESITES BY PLANNED DEVELOPMENT).
WHEREAS,a perpetual Private Access Way for roadway and utility
purposes,described as follows:
The South 14 feet of the West 475 feet of the North half
of the South half of the Northwest quarter of the Southwest
quarter of the Northwest quarter of Section 17;and the
North 14 feet of the West 475 feet of the South half of
the South half of the Northwest quarter of the Southwest
quarter of the Northwest quarter of Section 17,Township
1 North,Range 8 East of the Gila and Salt River Base and
Meridian,Apache Junction,Pinal County,Arizona;EXCEPT
for the West 50 feet thereof;
has been requested in Case PA -3-00;and
WHEREAS,said Private Access Way is for the benefit of providing ingress
and egress for the parcels described as follows:
PARCEL 1:The North half of the South half of the
Northwest quarter of the Southwest quarter of the
Northwest quarter of Section 17,Township 1 North,
Range 8 East of the Gila and Salt River Base and
Meridian,Apache Junction,Pinal County,Arizona;
EXCEPT the West 400 feet thereof (also known as
Pinal County Assessor parcel number 100-29-021G);
and
PARCEL 2:The East 122 feet of the West 400 feet
of the North half of the South half of the North-
west quarter of the Southwest quarter of the North-

8 East of the Gila and Salt River Base and Meridian,
Apache Junction,Pinal County,Arizona (also known
as Pinal County Assessor parcel number 100-29-021K);
and
PARCEL 3:The East 122 feet of the West 278 feet of
the North half of the South half of the Northwest
quarter of the Southwest quarter of the Northwest
quarter of Section 17,Township 1 North,Range 8
East of the Gila and Salt River Base and Meridian,
Apache Junction,Pinal County,Arizona (also known
as Pinal County Assessor parcel number 100-29-021M);
and
PARCEL 4:The West 156 feet of the North half of the
South half of the Northwest quarter of the Southwest
quarter of the Northwest quarter of Section 17,
Township 1 North,Range 8 East of the Gila and Salt
River Base and Meridian,Apache Junction,Pinal
County,Arizona;EXCEPT the West 33 feet thereof,
per quit claim deed recorded in Docket 934,Page 9,
Pinal County Records;and EXCEPT the East 17 feet
of the West 50 feet thereof,per fee #1998-018478,
Pinal County Records (also known as Pinal County
Assessor parcel number 100-29-021N);and
PARCEL 5:The South half of the South half of the
Northwest quarter of the Southwest quarter of the
Northwest quarter of Section 17,Township 1 North,
Range 8 East of the Gila and Salt River Base and
Meridian,Apache Junction,Pinal County,Arizona;
EXCEPT the West 447 feet thereof (also known as the
East ±213 feet of Pinal County Assessor parent
parcel number 100-29-021C);and
PARCEL 6:The East 198 feet of the West 447 feet
of the South half of the South half of the North-
west quarter of the Southwest quarter of the North-

8 East of the Gila and Salt River Base and Meridian,
Apache Junction,Pinal County,Arizona (also known
as the East 198 feet of the West 447 feet of Pinal
County Assessor parent parcel number 100-29-021C);and
PARCEL 7:The West 249 feet of the South half of
the South half of the Northwest quarter of the
Southwest quarter of the Northwest quarter of
Section 17,Township 1 North,Range 8 East of the
Gila and Salt River Base and Meridian,Apache
Junction,Pinal County,Arizona;EXCEPT the West
50 feet thereof (also known as the East 199 feet
of the West 249 feet of Pinal County Assessor parent
parcel number 100-29-021C);and
WHEREAS,the creation of the Private Access Way is necessary to provide
legal access for roadway and utility purposes to the above described
parcels;and
WHEREAS,on February 22,2000,the City of Apache Junction Planning and
Zoning Commission recommended approval of a 28 -foot -wide Private Access
Way to be located directly north of and adjacent to the south property
line of the following described property:
The South half of the South half of the Northwest
quarter of the Southwest quarter of the Northwest
quarter of Section 17,Township 1 North,Range 8
East of the Gila and Salt River Base and Meridian,
Apache Junction,Pinal County,Arizona;EXCEPT the
West 50 feet thereof;and
WHEREAS,satisfactory evidence has been received to indicate that the
requested Private Access Way does not present a potential hazard to
vehicular and/or pedestrian traffic;and
WHEREAS,the requested Private Access Way would not be detrimental to
the public health,safety and welfare of the City or its residents;
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that:

1.The Private Access Way described above be approved.
2.The paving requirements pursuant to the Apache Junction
City Code,Volume II,Land Development Code,Chapter
One,Zoning Ordinance,Article 20 Parking,Loading and
Interior or Private Street Standards,Section 20.0108,
shall be applicable to the creation of this Private Access
Way.
