A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,DECLARING ITS INTENTION TO ORDER STREETLIGHT
IMPROVEMENTS AND THE PURCHASE OF ELECTRICITY FOR SUCH IMPROVEMENTS
WITHIN A CERTAIN IMPROVEMENT DISTRICT TO BE KNOWN AS THE "APACHE
JUNCTION STREET LIGHT IMPROVEMENT DISTRICT NO.9911-1":AND PROVIDING
THAT THE COST OF THE ELECTRICITY BE ASSESSED ON THE DISTRICT.
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AS FOLLOWS:
WHEREAS,Arizona Revised Statutes Annotated (hereinafter "A.R.S.")§§48-615,48-
616,48-617 and 48-572 allow governing bodies of cities and towns to order
construction,reconstruction or acquisition of lighting plants and poles,wires,
conduits,lamps,standards and other appliances for the purpose of lighting and
beautifying streets;and
WHEREAS,state law also allows cities and towns to form improvement districts for
purchasing electricity for lighting of public streets;and
WHEREAS,cities and towns may also cause the electrical costs to be assessed to the
areas being served;and
WHEREAS,on or about November 18,1999,a petition signed by all of the real
property owners of Sunrise Shadows,a subdivision located wholly within the
corporate limits of the City of Apache Junction,was received by the Engineering
Division of the City's Public Works Department for the creation of a street light
improvement district;and
WHEREAS,City staff subsequently prepared a district map with the assistance of the
expected utility provider.Salt River Project,(hereinafter "SRP"),wherein the
locations of the lighting facilities and the estimated costs of such facilities
were identified;and
WHEREAS,the construction costs for such facilities have already been paid by the
developer,Beazer Homes,of the subdivision.
NOW,THEREFORE,BE IT RESOLVED,by the Mayor and City Council of the City of Apache
Junction.Arizona,that:
SECTION I
The public interest and convenience requires,and it is the intention of the Mayor
and City Council to order the purchase of electricity for lighting facilities

within the area bounded by and described as Sunrise Shadows Subdivision,as
recorded in Cabinet C.Slide 125,of the Pinal County Recorder's Office,Pinal
County,Arizona.(See map delineated as "Exhibit A",attached hereto).
The City has determined the type of lighting facilities to be installed and has
considered the rate to be paid for purchasing the electricity for the area
benefited.
The estimate of the cost and expenses,including the established rate of the energy
provider and the applicable taxes and adjustments,for the purchase of electricity
for the operation of the streetlights on file with the Engineering Division and the
City Clerk,is approved and adopted by the Mayor and City Council.
SECTION I I
The streetlights and the electricity are of more than local or ordinary public
benefit,and are of special benefit to the respective lots,pieces,and parcels of
land set forth in Exhibit A.
The Mayor and City Council make and order that the cost and expense for the
purchase of electricity be chargeable upon the district to be known as the -Apache
Junction Street Light Improvement District -,as more fully described in Exhibit A.
and declare that the District benefited by the purchase of streetlights to be
assessed,to pay the costs and expenses thereof in proportion to the benefits
derived therefrom.
SECTION III
In no event will the City of Apache Junction or any officer thereof,be liable for
any portion of the cost of supplying electricity to the district,nor for any
delinquency of persons or property assessed,unless the assessment for district
purposes against the property within such district exceeds the maximum assessment
contained in A.R.S.§48-616(D),which is one dollar and twenty cents per one-
hundred dollars of assessed valuation thereof in any year.in which event the City
shall be liable for such excess.
SECTION IV
The Mayor and City Council shall make an annual statement and estimate of the
expenses of the district,which shall be provided for by the levy and collection
of the ad valorem taxes of the assessed value of all property,real and personal,
within the district,as provided in A.R.S.§48-616(C)and amended thereto,which
taxes shall be collected as county taxes and collected in the amount shown by the
statement and estimate adopted by the Mayor and City Council.

SECTION V
The Mayor and City Council verify the ownership of the land described in the
district,and find that the petition in support of the formation of the district
was signed by all of the real property owners in the district,exclusive of
mortgages and other lienholders.Consequently,pursuant to A.R.S.§548-575(C).48-
615(A)and 48-617(A),the Mayor and City Council have immediate jurisdiction to
adopt this Resolution without the necessity of publication and posting of the
passage of this resolution.
SECTION VI
The City Manager or his designated representative shall take all steps necessary
to effectuate the direction under this resolution.
