HomeMy WebLinkAboutRES 00-36RESOLUTION NO.00-36 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,APPROVING THE FINAL SUBDIVISION PLAT AND FINAL PLANNED DEVELOPMENT PLAN FOR APACHE DREAM TOWNHOUSES SUBDIVISION, CASE SD -99-06,BY SAM ORLICH. WHEREAS,the subdivider in case SD -99-06 proposes to subdivide 5 gross acres in the Northwest quarter of the Northeast quarter area of Section 30,Township One North,Range Eight East of the Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona,into 30 residential lots pursuant to Arizona Revised Statutes (A.R.S.),Title 9, Chapter 4,Article 6.2,and pursuant to the Apache Junction City Code, Volume II,Land Development Code,Chapter 1,Zoning Ordinance,Article 19 Planned Development Zoning District,and Chapter 2,Subdivision Regulations;and WHEREAS,the Apache Junction Planning and Zoning Commission held a public hearing regarding the preliminary plat for SD -99-06 on January 11,2000,and recommended approval of the "Plat B"plan for Apache Dream Tounhouses,as described in case file SD -99-06 by a vote of 5-1-0;and WHEREAS,the Mayor and City Council of Apache Junction held a public hearing regarding the preliminary plat for SD -99-06 on February 15, 2000,and voted to approve the "Plat C"preliminary plat for Apache Dream Townhouses,as described in case file SD -99-06,per Resolution No. 00-05,by a vote of 7 to 0;and WHEREAS,the Mayor and City Council finds this final plat to be consistent with the Medium Density Residential designation,at one to six dwelling units per acre,of the 1987 Apache Junction General Plan and amendments thereto;and WHEREAS,this Council finds this proposed subdivision to be in compliance with the Apache Junction City Code,Volume II,Land Development Code,Chapter I ,Zoning Ordinance and Chapter 2,Subdivision Regulations,and Ordinance No.1103,which authorized the Planned Development zoning and preliminary plan for the property;and RESOLUTION NO.00-36 PAGE 1 OF 2 WHEREAS,this Council finds this proposed final plat for SD -99-06, Apache Dream Townhouses,is in substantial compliance with the approved preliminary plat. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that: I)The final subdivision plat for Apache Dream Townhouses is hereby approved. 2)The final Planned Development plan,which includes the improvements,landscape and amenity plans is hereby approved. 3)Staff is directed pursuant to A.R.S.§9-463.01(J)to record the final plat with the Pinal County Recorder and to collect the final plat recording fee from the subdivider and remit such amount to the Pinal County Recorder.
