HomeMy WebLinkAboutRES 00-37RESOLUTION NO.00-37 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,APPROVING A PRELIMINARY SUB- DIVISION PLAT,CASE SD -1-00,FOR SUPERSTITION FALLS COMMERCIAL SUBDIVISION,BY ROBERT SIEGEL AND JAMES MCMILLAN,REPRESENTED BY PHIL ENTZ OF URBAN TECH LTD. WHEREAS,the subdividers in case SD -1-00 propose to subdivide approximately 21 gross acres in the Southwest quarter of Section 35, Township One North,Range Eight East of the Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona,into eight (8) commercial lots pursuant to Article 6.2 of Chapter 4 of Title 9, Arizona Revised Statutes,and pursuant to the Apache Junction City Code,Volume II,Land Development Code,Chapter 2,Subdivision Regulations:and WHEREAS,the Apache Junction Planning and Zoning Commission held a public hearing regarding SD -1-00 on October 24,2000,and recommended approval of the preliminary plat for Superstition Falls Commercial Subdivision,as described in case file SD -1-00,by a vote of 6-0-0, with conditions;and WHEREAS,the Apache Junction City Council held a public hearing regarding SD -1-00 on September 2,2003,and voted to approve the preliminary plat for Superstition Falls Commercial Subdivision,as described in case file SD -1-00,by a vote of 5-0-0:and WHEREAS,this Council finds this proposed subdivision to be in compliance with the Employment/Retail opportunity designation of the Apache Junction General Plan;and WHEREAS,this Council finds this proposed subdivision to be in compliance with the Apache Junction City Code,Volume II.Land Development Code,Chapter 1,Zoning Ordinance,and Chapter 2, Subdivision Regulations;and WHEREAS,this Council finds this proposed subdivision to be consistent with the planned development plans and zoning approvals granted under Ordinance No.1042,the original C-3/PD rezoning: Ordinance No.1144,the plan for the North Commercial Tier:and Ordinance No.1146,the plan for the Apache Junction Medical Center: and RESOLUTION NO.00-37 PAGE 1 OF 3 WHEREAS,this Council finds that the conditions of approval required for this subdivision are necessary for sound and orderly community development,for preservation of community values and for the promotion of the general health,safety,convenience and welfare of the citizens of Apache Junction. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that: Said preliminary plat,SD -1-00,Superstition Falls Commercial Subdivision,be approved subject to the following conditions of approval: 1)The entry road shall remain private.However,there shall be easements recorded for public,vehicular and pedestrian use and utilities,with a commitment for maintenance,across all lots served by said private roadway. 2)Show the existing street lights along the entry drive. 3)The sidewalks on the north side are to be completed as each lot is developed.If all lots are not developed within 12 months,the developer shall provide sidewalks along the north side of the entry drive. 4)The developers shall dedicate and construct any additional right- of-way improvements necessary for deceleration lanes for the drive between Lots 1 and 2,and for the main entry to the hospital along Goldfield Road,at the time said properties are developed. 5)Land to be dedicated to the public is to be free and clear of any encumbrances.All trust deed holders or other lienholders are to sign a ratification statement on the final plat releasing their interest within the portions being dedicated.All documented restrictions are to be removed from the portions being dedicated. 6)Show the proposed sewer lines to serve Lots 4,5,6 and 7. 7)The developer shall complete the public improvements including paving,curb,gutter,and sidewalk along Goldfield Road north of the entry drive. RESOLUTION NO.00-37 PAGE 2 OF 3 8)All requested pieces of information shall be provided to the City Engineer's Office and all necessary notes shall be added to the preliminary and final plat maps before they shall be presented to the City Council for final approval. 9)The design of the subdivision and other applicable conditions of approval of the Planned Development portions of the subdivision,as approved,shall be observed and remain in full force and effect.
