HomeMy WebLinkAboutRES 00-38RESOLUTION NO.00-38 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,APPROVING THE FINAL SUBDIVISION PLAT FOR SUPERSTITION FALLS COMMERCIAL SUBDIVISION,CASE SD -1-00,BY ROBERT SIEGEL AND JAMES MCMILLAN,REPRESENTED BY PHIL ENTZ OF URBAN TECH LTD. WHEREAS,the subdividers in case SD -1-00 propose to subdivide approximately 21 gross acres in the Southwest quarter of Section 35, Township One North,Range Eight East of the Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona,into eight (8) commercial lots pursuant to Article 6.2 of Chapter 4 of Title 9, Arizona Revised Statutes,and pursuant to the Apache Junction City Code,Volume II,Land Development Code,Chapter 1,Zoning Ordinance, Article 19 Planned Development Zoning District,Chapter 2,Subdivision Regulations;and WHEREAS,the Apache Junction Planning and Zoning Commission held a public hearing regarding the preliminary plat for SD -1-00 on October 24,2000,and recommended approval of the plat for Superstition Falls Commercial Subdivision,as described in case file SD -1-00,by a vote of 6-0-0;and WHEREAS,the Mayor and City Council of Apache Junction held a public hearing regarding the preliminary plat for SD -1-00 on September 2,2003,and voted to approve the preliminary plat for Superstition Falls Commercial Subdivision,as described in case file SD -1-00,per Resolution No.00-37,by a vote of 5-0-0;and WHEREAS,the Mayor and City Council finds this final plat to be consistent with the Employment/Retail opportunity designation of the Apache Junction General Plan;and WHEREAS,this Council finds this proposed subdivision to be in compliance with the Apache Junction City Code,Volume II,Land Development Code,Chapter 1,Zoning Ordinance,and Chapter 2, Subdivision Regulations,and Ordinance Nos.1042,1144 and 1146. Which authorized the rezoning and Planned Development plans for the property;and RESOLUTION NO.00-38 PAGE 1 OF 2 WHEREAS, this Council finds this proposed final plat for SD -1-00, Superstition Falls Commercial Subdivision,is in substantial compliance with the approved preliminary plat. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona.that: 1)The final subdivision plat for Superstition Falls Commercial Subdivision is hereby approved. 2)Staff is directed pursuant to A.R.S.§ 9-463.01(3)to record the final plat with the Pinal County Recorder and to collect the final plat recording fee from the subdivider and remit such amount to the Pinal County Recorder.
