HomeMy WebLinkAboutRES 00-43RESOLUTION NO.00-43 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,APPROVING THE APPLICATION FOR LOCAL, REGIONAL AND STATE PARK FUNDS FOR THE SOUTHERN AVENUE PARK DEVELOPMENT WHEREAS,pursuant to A.R.S.§41-503,the Arizona Legislature has granted the authority to establish local,regional and state park programs which provide funds to the State of Arizona and other eligible applicants for acquiring lands and developing facilities for public outdoor recreation purposes;and WHEREAS,Arizona State Parks Board (hereinafter "Board")is responsible for the administration of the above -referenced program within the State of Arizona, and establishes necessary rules and procedures governing application by state and local agencies;and WHEREAS,the procedures adopted by the Board require the applicant to certify by resolution the approval of applications,signature authorization,the availability of local matching funds,and authorization to sign a participation agreement with Board prior to submission of said applications to the Board;and WHEREAS,. the City of Apache Junction (hereinafter "City") controls through a special use agreement portions of approximately 25 acres located southwest of the Southern Avenue and San Marcos Road Alignment intersection,all located within the corporate limits of the City of Apache Junction,Pinal County, Arizona,more adequately depicted in Exhibit A,attached hereto;and WHEREAS,the City,has identified a need for park system expansion to include the above -referenced property through a public planning process;and WHEREAS,there is a need to increase recreational opportunities for all age groups and interests and the subject property would provide an area to service such needs of the community;and WHEREAS,the City is a recognized municipal corporation in the State of Arizona and qualifies as an applicant having a legitimate recreational or public purpose for applying for use of such land;and RESOLUTION NO. 00-43 PAGE 1 OF 3 WHEREAS,pursuant to 43 U.S.C.§869(a),the land in question is to be used for a proposed park expansion project and such land is not of national significance nor is more than reasonably necessary for the proposed park expansion use. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,as follows: I)The City Council shall control through a special use agreement all of the above -referenced land and improve i t for recreational opportunities. 2)The City agrees to comply with all appropriate procedures, guidelines,and requirements established by the Board as a part of the application process. 3)The City will comply with all appropriate state and federal regulations,policies,guidelines,and requirements as they relate to the application. 4)The City has matching funds in the amount of $250,000 from the General Fund and Development Fees. 5)The Parks and Recreation Director Jeff Bell is appointed as the agent of the City of Apache Junction to conduct all negotiations,execute and submit all documents including,but not limited to applications,agreements,amendments,billing statements,which may be necessary for the completion of the aforementioned project. 6)The City Manager through his office or by delegation to the Parks and Recreation Department is directed to draft and file an application to accomplish the goal of this resolution in a timely manner. 7)The City Clerk is authorized and directed to send certified copies of this resolution to the Arizona State Parks Board and RESOLUTION NO. 00-43 PAGE 2 OF 3 other agencies as determined appropriate by the Parks and Recreation Department Director.
