A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AUTHORIZING THE CREATION OF A TWENTY-EIGHT FOOT (28')WIDE PRIVATE
ACCESS EASEMENT PURSUANT TO THE CITY CODE OF APACHE JUNCTION,VOLUME II,LAND
DEVELOPMENT CODE,CHAPTER 1,ZONING ORDINANCE,ARTICLE 20 PARKING.LOADING.
AND INTERIOR OR PRIVATE STREET STANDARDS,SECTION 20.0108 PRIVATE ACCESS WAY
STANDARDS,IN CASE PA -2-99,FOR THE PURPOSE OF PROVIDING LEGAL ACCESS TO
CERTAIN GR (GENERAL RURAL) -ZONED PARCELS DESCRIBED HEREIN.
WHEREAS,a perpetual Private Access Easement described as follows:
The West 28 feet of the North 515 feet of the West half of the Northeast
quarter of the Southwest quarter of the Northwest quarter of Section 21,
Township One North,Range Eight East,of the Gila and Salt River Base and
Meridian,Apache Junction,Pinal County,Arizona;EXCEPT for the North 33 feet
thereof;
has been requested in Case PA -2-99;and
WHEREAS,said Private Access Easement is for the benefit of providing
ingress and egress for the lots which will result from the future land split
of the above described parcel,in which no more than two 1.25 -acre,and one
2.5 -acre lots shall be created by the present owners for the purpose of lease
or sale of said future lots;and
WHEREAS,the creation of the Private Access Easement is necessary to
provide legal access to the future lots proposed to be created from the above
described parcel;and
WHEREAS,the City of Apache Junction Planning and Zoning Commission did
on November 23,1999,recommend approval of the Private Access Easement;and
WHEREAS,satisfactory evidence has been received to indicate that the
requested Private Access Easement does not present a potential hazard to
vehicular and/or pedestrian traffic;and
WHEREAS,the requested Private Access Easement would not be detrimental
to the public health,safety and welfare.

NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that the Private Access Easement,as described
above,be approved subject to the following conditions:
1.The applicants shall construct a paved 28 -foot -wide by 515 -foot -long (as
measured form the centerline of W.Scenic Street)Private Access
Easement for perpetual ingress,egress and utility purposes for the
proposed lots.The curbing,gutter,sidewalk and streetlight
improvement requirements of Section 20.0108 shall be waived.
2.The applicants shall coordinate with Planning Staff to create proper
legal documents to be recorded for the Private Access Easement.
3.The property owners shall dedicate to the City any necessary cut-off
corners as determined by the City Engineer.
4.The applicants shall have the property surveyed and provide Planning
Staff with a copy of said survey map.
5.The applicants shall contact and coordinate with the City Engineer to
construct the Private Access Easement according to City paving standards
and to receive an encroachment permit to connect said easement to W.
Scenic Street.
6.The applicants shall inventory and salvage all significant plants
(Saguaros,Palo Verdes,Chollas,etc.)in the Private Access Easement
area,to be coordinated with Planning and/or Parks and Recreation Staff.
7.Proper and visible address markers shall be located along Scenic Street
for the three new lots.
