A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION, ARIZONA,EXTENDING SUPPORT FOR STATE INITIATED MEASURES TO
PROTECT RESIDENTS IN MOBILE AND MANUFACTURED HOME AND RECREATIONAL
VEHICLE PARKS FROM UNREASONABLE RENT INCREASES;AND DECLARING AN
EMERGENCY.
WHEREAS,residents in mobile and manufactured home and recreational vehicle
parks have recently complained to the City of Apache Junction about landowners
charging unreasonable rental increases for unit spaces;and
WHEREAS,at the City Council Regular Session of January 18,2000,
approximately eighteen citizens residing in mobile and manufactured home and RV
parks protested unreasonably high rental increases imposed upon them by their
landlords;and
WHEREAS,such rental increases were purportedly made by the new owners of
such rental parks;and
WHEREAS,the Arizona Residential Landlord and Tenant Act,codified in
Arizona Revised Statutes Annotated ("A.R.S.")§33-1301 et seq.,and the Arizona
Mobile Home Parks Residential Landlord and Tenant Act,codified in A.R.S.§33-
1401 et seq.,limit the authority of cities and towns to control rents on private
residential property;and
WHEREAS,A.R.S. §§33-1406 and 33-1407 specifically apply the provisions of
the Mobile Home Parks Residential Landlord and Tenant Act to mobile homes which
are placed on rental spaces;and
WHEREAS,such mandated state control undermines the ability of cities and
towns containing mobile or manufactured home parks to adequately protect its
citizens from excessive rent increases imposed by park owners;and
WHEREAS,City residents testified the rent adjustments made in their
respective parks are unjustified as compared to their operating costs and capital
improvement expenses claimed by the park owners;and
WHEREAS,the above -referenced Landlord and Tenant Acts fail to insulate
retirees,many with serious medical conditions,from the unreasonable rent
increase practices of park owners;and

WHEREAS,the consequences of allowing these unjustified rental increases
include reduction in resale value of mobile and manufactured homes located on
rented spaces within parks,loss in state and local sales tax revenue due to a
reduction in the amount of winter visitors who traditionally reside in Arizona
for selected months,and an increase in defaults on mortgages,bankruptcy
filings,and homelessness.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF APACHE
JUNCTION,ARIZONA AS FOLLOWS:
Section 1.The City of Apache Junction hereby requests the Arizona
Legislature and Governor Jane Hull work together and pass an amendment to the
Arizona Residential Landlord and Tenant Act and the Arizona Mobile Home Parks
Residential Landlord and Tenant Act,codified in A.R.S.§§33-1301 et seq.and 33-
1401 et seq.respectively,which increases the rights of mobile home and
manufactured homeowners using rented spaces in mobile and manufactured home
parks.Such amendment should strengthen the burden on the park owners to more
fully justify rent increases,or in the alternative should allow cities and towns
to adopt and enforce its own rent control regulations within their annexed
territories as applied to rental spaces.
Section 2.The Mayor is hereby authorized to sign this resolution on
behalf of the City of Apache Junction in support of the above -noted proposition.
Section 3.Staff is hereby directed to send via first class mail or by
electronic means an executed copy of this resolution to each and every member of
the State Legislature and to the Governor within 10 working days after adoption
of this Resolution.
Section 4.Because the Arizona Legislature is currently in session,the
immediate operation of the provisions of this Resolution is necessary to preserve
the public peace,health or safety.An emergency is hereby declared to exist.
This Resolution shall be in full force and effect from and after its passage,
adoption and approval by the Mayor and Council of the City of Apache Junction.
