HomeMy WebLinkAboutRES 00-05RESOLUTION NO.00-05 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,APPROVING A PRELIMINARY SUBDIVISION PLAT,CASE SD -99-06,FOR APACHE DREAM TOWNHOUSES,BY SAM ORLICH,REPRESENTING CONNIE YOUNG. WHEREAS,the subdivider in case SD -99-06 proposes to subdivide 5 acres in the Northwest quarter of the Northeast quarter area of Section 30,Township One North,Range Eight East of the Gila and Salt River Base and Meridian, Pinal County,Arizona,into 30 townhouse lots pursuant to Article 6.2 of Chapter 4 of Title 9,Arizona Revised Statutes,and pursuant to the Apache Junction City Code,Volume II,Land Development Code,Chapter 2,Subdivision Regulations;and WHEREAS,the Apache Junction Planning and Zoning Commission held a public hearing regarding SD -99-06 on January 11,2000,and recommended approval of the "Plat B"plan for Apache Dream Townhouses,as described in case file SD -99-06,by a vote of 5-1-0;and WHEREAS,the Apache Junction City Council held a public hearing regarding SD -99-06 on February 15,2000,and voted to approve the "Plat C" preliminary plat for Apache Dream Townhouses,as described in case file SD -99- 06,by a vote of 7-0-0;and WHEREAS,this Council finds this proposed subdivision,Plat C,to not be in conflict with the Medium Density designation of the Apache Junction General Plan;and WHEREAS,this Council finds this proposed subdivision,Plat C,to be in compliance with the Apache Junction City Code,Volume II,Land Development Code,Chapter 1,Zoning Ordinance,and Chapter 2,Subdivision Regulations;and WHEREAS,this Council finds that the conditions of approval required for this subdivision are necessary for sound and orderly community development, for preservation of community values and for the promotion of the general health,safety,convenience and welfare of the citizens of Apache Junction. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that: Said preliminary plat,SD -99-06,Apache Dream Townhouses Plat C,be conditionally approved subject to the following conditions of approval: RESOLUTION NO.00-05 PAGE 1 OF 3 1)The property owners shall install any necessary on -site and off -site improvements,as determined by the City Engineer,including but not necessarily limited to,paving,gutters,curbs,sidewalks,streetlights, fire hydrants,utilities and on -site retention basins. 2)The property owner shall dedicate,on the final plat drawing,an additional five feet of right-of-way along the west boundary of the subdivision for necessary streetlights and other utility placement.A reduction of five feet of width shall be deducted from the central open space area and from the retention/open space tracts at the four corners of the subdivision. 3)The applicant shall provide as much usable open space as possible in the design of the subdivision;said usable open space areas,particularly in the central areas,to include generous amounts of turf and trees for cooling. 4)All open spaces shall be maintained by a Homeowners Association. 5)The retention basins are to be designed with curvilinear shapes and all usable open spaces are to be located above the 10 year 24 hour storm level.
