M. CALL TO PUBLIC
At this time the public has the privilege to address the council with requests, communications, comments
or suggestions relating to city business.All speakers must have already submitted a written "Request to
Speak"form to the city clerk no later than the conclusion of the city manager's report portion of the
agenda. If there is a group speaking on the same item, they should select a spokesperson.All such
remarks shall be addressed to the council as a whole and not to any member thereof. The mayor is
authorized to ask a speaker to stop speaking and leave the podium or to adjourn the meeting if anyone
becomes disorderly, uncivil, makes personal attacks or continues to speak about items that are not
within the jurisdiction of the city after being warned such issues are beyond the jurisdiction of the city to
act. The council may not answer questions of the speaker, discuss the matter with one another, but may,
at the conclusion: 1)respond to criticism by a speaker, 2)ask the city manager to review a matter, 3)
ask the city manager to place the matter on a future agenda. Each speaker must approach the podium,
speak into the microphone,provide their name and address. There is a three(3)minute time limit per
speaker.

4. 24-446 Consideration of approval of the Economic Development Agreement with the
Greater Phoenix Economic Council (GPEC), retroactive to July 1, 2024, for
economic development services for the term of one year(FY24/25) in the
amount of$19,320.00, and the appointment of Councilmember Peter Heck as
the City of Apache Junction representative to the GPEC Board of Directors.
5. 24-498 Consideration of approval of professional services agreement with Teresa
Monica Hunt for public defender services. This agreement will be for a period
of three years beginning July 3, 2024 and ending on June 30, 2027.
6. 24-500 Consideration of approval of employment agreements with Douglas S.
Campbell, Lisa M. Johnson, Michael Kielsky, and Dai Trang Nguyen as
associate magistrates for on-call/as needed service. The new employment
agreements will be for a period of four years beginning July 3, 2024 until June
30, 2028.
E. AWARDS, PRESENTATIONS AND PROCLAMATIONS
7. 24-503 Proclamation designating July 2024 as "National Parks and Recreation
Month."
Mayor Wilson read the Proclamation designating July 2024 as"National Parks and Recreation
Month", and presented it to the Parks and Recreation staff. Recreation Superintendent Jamie
Sullivan shared that July is their most employed month due to all the recreation activities, so it is
the perfect time to celebrate their team. She also played a video that showcased the various
activities and events Parks and Recreation offers.
F. REGIONAL INTERGOVERNMENTAL UPDATES
8. 24-526 Brief summary of intergovernmental updates from mayor and
councilmembers.
Mayor Wilson announced that he was recently appointed to the Transportation Policy
Committee by the Maricopa Association of Governments. He is one of nineteen members with
over 27 cities that will address the roads in Maricopa and Pinal counties. He will also be serving
on the Resolution Committee for the League of Arizona Cities and Towns.
G. CITY MANAGER'S REPORT
9. 24-527 City Manager's Report.
Assistant City Manager Matt Busby stated City Manager Bryant Powell is away on vacation and
there is no manager report.

10. Announcement of Current Events.
Management Analyst Eli Richardson shared the following events:
-4th of July celebration at Superstition Shadows Park' 1001 W. Southern Ave. Apache Junction'
AZ. Doors open at8:00p.m. and the fireworks show starts at8:30p.m.
-The Concentrated Downtown Master Plan Update Open House on July 10, 2024, 6:00 p.m. -
7:30 p.m. at the Multi-Generational Cantar, 1035 N. Idaho Rd. Apache Junction, AZ.
H. PUBLIC HEARINGS
11. Consideration of application for new Series 12 Restaurant Liquor License
for K8aggio'a Lounge located at 100 N Plaza Orive, Apache Junotion, AZ. The
next step in the process is for the council to hold a public hearing on the
application and make a recommendation of approval ur denial to the Arizona
Department of Liquor License and Control.
Councilmember Cross moved,seconded by Councilmember Soller that the application for a new
Series 12 Restaurant Liquor License for Maggie's Lounge located at 100 N.Plaza Drive be
recommended for Approval to the Arizona Department of Liquor Licenses and Control.

City Clerk Jennifer Pena stated the city received on application for onew Series 12 Restaurant
Liquor License for K4oggie'a Lounge located at 100 N. Plaza Drive, on June 3. 2024. and the
Notice of Posting was placed at the establishment nn June 4. 2024.
The posting requirement has been met with no comments from the public. Correspondence
related to inspections of the premises for safety and code compliant matters have been
received from the Apache Junction Police Department, Planning and Zoning Depadmant.
Building and Sah*h/ Division and the Superstition Fine and Medical District. All four entities find
compliance with the inspection requirements and recommend approval.
Development Services added that this applicant has a current building permit in process for
tenant improvements to convert a previous health food store into a restaurant. The property is
zoned B-3, which allows restaurants and bars outright. The liquor license application can go
through the pnnceoo, but until the business io complete with the renovation and an approved
inspection and Certificate of Occupancy have been granted, no business will be allowed at the
location.
Mayor Wilson opened the public hearing, receiving no comments, he closed the public hearing.

12. 24-511 Presentation and discussion on procurement of a records management
system, Laserfiche, from ICC Community Development Solutions utilizing
OMNIA cooperative contract#01-158, in an amount of$56,756.00.
Information Technology Director Doug Wirthgen presented a document management system
centralizes and secures content, improves collaboration and supports compliance. Laserfiche
Workflow is a business process automation tool. It is built into Laserfiche so an organization
can use automatic document classification, organizing, routing, and archiving. Laserfiche uses
a computer system and software to store, manage and track electronic documents and
electronic images of paper-based information captured using a document scanner.
The City of Apache Junction agrees with ICC Community Development Solutions and to the
License Agreements for the software Laserfiche Self Hosted Subscription site license
introduces a straightforward software license that includes a wide variety of features to benefit
all departments of the municipality.As staff becomes more familiar, automation can be added,
as well as integration with 3rd party applications and more.
The cost of this comprehensive project is$56,756, which will be paid for using FY24 CIP council
approved general funds that have been carried forward to council approved FY25 CIP.
Councilmember concerns included:feedback from other cities using this system, compatability
with Microsoft, contract period, what is included in the subscription fee and how the system
works.
Mr. Wirthgen responded to all concerns.
13. 24-520 Presentation and discussion on proposed agreement between the City of
Apache Junction and Safeware, Inc. for the purchase of a Mobile Command
Vehicle using American Rescue Plan Act(ARPA)funds in the amount of
$1,787,302.16.
Police Chief Michael Pooley presented the Apache Junction Police Department has formally
asked to use funds from the American Rescue Plan Act("ARPA")to purchase a Mobile
Command Vehicle (MCV). The city auditor has approved the request to use ARPA funds to
acquire the MCV, which costs$1,787,302.16. This new MCV will replace the current one that is
over 20 years old.
Below are several key advantages offered by the MCV:
1. Enhanced coordination and communication with internal and external law enforcement
partners
2. On-site emergency incident management
3. Advanced technology and equipment made available at any location necessary
4. Mobile crime labs and evidence processing
5. Rapid deployment and flexibility to urban and remote areas
6. Mobile incident command post
7. Support for Search and Rescue Operations
8. Public Relations and Media Management
The primary role of a MCV is to help during active public safety emergencies and operations,

such as major criminal investigations, natural disasters, special events, and rescue operations.
MCV's serve as pivotal assets in bolstering emergency response capabilities, facilitating
enhanced communication, and enabling efficient incident management. Their mobility and
advanced technology render them indispensable tools for public safety agencies.
The purchase of this specialty vehicle will allow the Apache Junction Police Department to
continue to be in line with other law enforcement agencies across the country.
Councilmember concerns included: benefits of the mobile unit, conditions of the funding being
used, when the vehicle will be available and where it is being assembled.
Chief Pooley responded to all concerns.
14. 24-522 Presentation and discussion on award of contract to Veregy for sports field
lighting retrofit projects within city parks in an amount not to exceed
$1,784,427.75 which includes a 5% contingency.
Parks and Recreation Director Liz Langenbach presented the sports field and arena lighting
within City of AJ Parks and Rec facilities are among some of the oldest infrastructure in our
parks. Last year, Prospector Park softball fields#1  were retrofitted. This year budget
amounts have been set aside to complete the softball complex by retrofitting fields#3 .
City staff has selected Musco Lighting. They are one of the premier manufacturers for sports
field lighting, with a focus on energy-efficient, shielded LED lighting. There are several reasons
why this is the best choice for the facilities:
1. This is the same system that is at the Little League fields and Prospector Park fields#1 
and their automated system is already integrated into the facility reservation software and
additionally allows light activation by staff from a mobile device or a computer.
2. Musco has experience designing systems that are compliant with Dark Sky Friendly Sports
Field Lighting, and the City's application with their design has already been approved by DarkSky
International.
3. Over time, the city will have substantial savings through lower electrical costs and lower
maintenance/replacement costs.
This project was approved in the FY25 budget for fields#3 . However, staff has also
identified potential grants to complete the remaining sports fields at Prospector Park and
Superstition Shadows Park, utilizing the budgeted funds as a match. For this reason, staff has
included a clause in the contract that allows the city to lock in pricing for the additional projects if
the necessary additional grant funding is received.
The City will utilize Musco's vendor, Veregy, for this replacement project under the 1 Government
Procurement Alliance (1 GPA)Cooperative Contract 22-11 PV-08, thus fulfilling procurement and
open market procedures.
Staff is recommending a construction contract be awarded to Veregy, in an amount not to
exceed $1,784,427.75, which includes a 5% owner-controlled contingency for unforeseen

circumstances. If the city does not receive the additional grant funding, then only fields#3 
will be completed this year.
Councilmember concerns included: other funding that can be used and how the funding
process works.
Ms. Longanbonh responded to all concerns.

Andre Meek 1327 S Belair Road,Apache Junction, commented on road safety along Royal
Palm Road and proposed adding reflectors on the island for the left turn.
Donna Carr, 2178 W. Virginia St, Apache Junction, shared her thoughts on the new bill passed
by Governor Hobbs mandating new rules for operating off-road vehicles.

supports compliance. Laserfiche Workflow is a business process automation tool. It is built into
Laserfiche so an organization can use automatic document classification, organizing, routing,
and archiving. The use of a computer system and software to store, manage and track
electronic documents and electronic images of paper-based information captured through the
use of a document scanner.
The City of Apache Junction, Pina) County, Arizona hereby agrees with ICC Community
Development Solutions and to the License Agreements for the software Laserfiche Self-
Hosted Subscription site license introduces a straightforward software license that includes
a wide variety of features to benefit all departments of the municipality. As you become
more familiar, we can add automation, integration with 3rd party applications and more.
The cost of this comprehensive project is $56,756, which will be paid for using FY24 CIP council
approved general funds that have been carried forward to council approved FY25 CIP.
Staff recommends approval of: Go-Live and Post-Implementation Support Phase on or before
June Ist, 2025. Self-hosted subscription based Laserfiche with ICC-CDS implementation &
Training.

Adjustments to Performance Schedule; Delays:
Adjustments to Schedule: Upon the mutual consent of the Municipality and ICC Community
Development Solutions,the "Performance Schedule" may be changed or extended as provided
under"Delays" below.
Delays:Client must notify ICC Community Development Solutions, in writing,immediately upon
learning or otherwise becoming aware,of any difficulties that may delay the delivery of services or
deliverables within each step of the Implementation timeline. Such notification must identify the
reason for the delay,as well as the anticipated period of delay.Any delay on the part of the customer
that extends 10 city working days (not including Fridays) beyond the target date for completion of
any step will result in a project restart and additional charges will be identified as part of a change
order provided to the customer. This clause shall not apply in case of force majeure.

Responsibilities of Vendor
• Vendor shall assign qualified personnel to perform the services required under this Agreement.
• Vendor shall schedule meetings and project work as quickly as possible to meet the Milestones

• Vendor commits to complete the Project in accordance with the timeline set forth in the
Milestones and Timeline section.
• Vendor shall offer weekly meetings to Client, reporting on the status of the Project and
discussing any issues that may impact the timeline.
Responsibilities of Client
• Client shall provide Vendor with remote and monitored access to all necessary information,
servers, and personnel required for the implementation of the Project. These requirements will
be described by name in the kickoff meeting.
• Client shall provide server(s) provisioned as described during the Kickoff Meeting within 1 week
of the kickoff meeting.
• Client shall designate a Project Manager during the Kickoff Meeting. This Project Manager will
ensure that:
o Client-side personnel are present at scheduled meetings.
o Client-side personnel complete tasks assigned during the project.
o Appropriate personnel are consulted during planning to ensure processes are
documented/developed correctly.

SOFTWARE ORDER, PAYMENT AND PERFORMANCE SCHEDULE
Kickoff Meeting
• $28,101.00 of the project price shall be invoiced upon customer site activation, immediately
following the Kickoff Meeting,on or before August 151h, 2024. This covers the software licensing
for a single year and is a non-refundable amount, per Laserfiche. Subscription software may be
cancelled after this initial year.
Planning and Installation Phase
• $2,000.00 of the Configuration and Training services shall be invoiced as completed, on or
before September 2nd, 2024.
• Other Services: These services have not been fully scoped and could be completed within any
phase on the timeline depending on the needs of the customer. Scoping will take place
during planning and a timeline will be created. ICC-CDS will invoice only the hours used
during each phase.
• $3,360.00 of the Custom Development services shall be invoiced as completed.
• $11,700.00 of the Forms and Workflow Development services shall be invoiced as
completed.
Configuration and Admin Training Phase
• $6,600.00 of the Configuration and Training services shall be invoiced as completed, on or
before February 6th, 2025.
• $1,995.00 of the Records Retention Essentials services shall be invoiced as completed, on or
before February 6th, 2025.
User Training,Testing and Acceptance Phase
• $3,000 of the Configuration and Training services shall be invoiced as completed, on or
before February 6th, 2025.

satisfaction of the Client at each specified milestone(milestones and objectives met as defined in this
document and the documentation created in the planning phase). Prior to project advancement and the
generation of associated invoices (payment terms of Net30),the Client is required to grant explicit approval
for each milestone. Prompt adherence to these milestones is considered paramount, and any deviation

APPENDIX A - INSTALLATION, TRAINING AND SUPPORT
Pre-Installation Teleconference and Technical Review
If applicable, prior to the installation and training,one of ICC-CDS's technicians will work with your technical
staff or consultant to review the hardware and other technical requirements and ensure that all hardware is
ready for the installation. We will also work with your designated contact person to establish the agenda for
the on-site days.
Customized Training
If you are receiving training, ICC-CDS provides practical training sessions to ensure that your users keep pace
with "best practices" and that your Laserfiche system continues to provide your organization with the
maximum efficiencies possible. Whether you area new Laserfiche user or an existing user seeking refresher
training, we pride ourselves on maintaining a team of trainers who can relate to users at any level of
expertise.
Our standard Laserfiche user training covers the basic functions of the program and provides you
with the necessary skills to put the system into immediate use. Based on the file organization and file
naming structures that were determined by your organization,the training covers input, search and
manipulation features using your documents to address file-organization and file-naming structures
Administrator Training covers the system administrative functions and typically takes place
throughout the on-site sessions, as appropriate.
TECHNICAL SUPPORT
Technical Support covers all questions that might arise with your Laserfiche system should a
technical issue arise. Technical Support covers the installation of software patches and minor
upgrades, as appropriate.
The first line of technical support is via telephone, using our toll-free number(855-436-5500) or via
e-mail at Ifsupport@icc-cds.com. With Basic Support service,technical support requests not
immediately addressed will be acknowledged within 8 business hours, with the majority of response
times within 2 hours. ICC-CDS's support technician will discuss the issue with you. If there are more
detailed diagnostics needed, the technician will log into your system remotely, using the Internet. In
this way,the technician can see what the user is seeing, do diagnostics, and generally remedy the
situation remotely during this initial contact. In situations that require additional research or work
by the technician,we will let you know what still needs to be done, along with a timeframe for
getting back to you. You will also receive a Case number for future reference. By providing remote
diagnostics and remediation to our clients,we can provide you with quick resolution of your issues
to keep you up and running.
SOFTWARE PATCHES AND UPGRADES:
In addition to receiving technical support, customers with a current SAAS contract will receive critical
program updates within the current version of Laserfiche. This is extremely important because
Laserfiche is continuously improved to be even more powerful and efficient. You will receive routine
system updates released by the manufacturer after a period of additional ICC-CDS in-house testing, as

applicable. These patches and software upgrades are available for download at our FTP site. Customers
are given the option of applying the patches themselves or having one of our Laserfiche technicians apply
the patch remotely.
There is no additional cost for the installation of minor software updates or patches (typically called 'point
releases'). Major software updates(typically called 'version releases') may have associated service charges
to install, upgrade, or to migrate your Laserfiche software to the new major release level. Related training
on new functionality of the upgraded software may also have associated service charges. Any additional
charges will be outlined and quoted to you in advance.
LASERFICHE OFF-HOURS SYSTEMS UPGRADES:
At times it is a requirement that Laserfiche systems upgrades are done during off hours or over the weekend
to minimize operational interruptions. ICC-CDS is happy to work with our customers to accommodate these
requirements. With changes in the law regarding payment of overtime for non-exempt helpdesk staff that
are involved in doing work after hours or over the weekend,they must be paid overtime. ICC-CDS is going
to begin charging a nominal fee for the off-hours work to cover this new expense. The charge will not
exceed $500.00 for the time involved.
Services covered under SAAS:
• Remote troubleshooting and repair to the best of our ability of any errors generated by Laserfiche
• Remote troubleshooting and repair to the best of our ability any Laserfiche functionality that is not
working
• Provide and remotely apply minor patches/point releases on an as needed basis
• Respond to request calls within 8 business hours, if not immediately
• Provide technical support between the hours of 8:00 AM -5:00 PM EST
• Provide access to all major and minor patches provided by Compulink Laserfiche
• User group meetings
• Access to Laserfiche's knowledgebase
• Access to webinars
Services not covered under SAAS:
• Training- New user or refresher training-either on-site or remote
• Repair of damaged databases
• Establishment of SQL maintenance plan
• Addition of custom features or functionality to the software
• Support or troubleshooting of third party software
• Faults or problems caused by unauthorized access to configuration information or changes to
components by the user or a third party.
• Installation, Migration, Upgrading of software related to major software releases
• Problems or faults caused by use of the product outside its normal operating conditions.

PC, replacement of existing PCs or server(s), and changes in network configurations, such as server
name, IP address or workgroup on PCs.
• To have Internet access on the Laserfiche server and all workstations where the Laserfiche client is
installed and be willing to allow our Support Technicians remote access to the Customer's Laserfiche
system via GoToAssist or other acceptable remote access tool.
• To designate an IT contact and to provide the name, phone number and e-mail address on the
registration form.
• To describe technical issues completely in order to provide ICC-CDS's Support Technician sufficient
information to be able to diagnose and reproduce the problem, including any identified error codes.

All cable runs shall be full length, no splices. All cable terminals shall be staked and soldered.
All cable shall be enclosed in convoluted polyethylene tubing and the ends of the cable shall be
sealed with color-coded shrink-wrap identifying the function of the cable.
•All added electrical branch circuits shall be protected from over-current by resettable circuit
breakers appropriately rated for the load. Only circuit breakers shall be used in the installation
of added electrical branch circuit wiring (plug type fuses are unacceptable).
• Circuit breaker functions shall be identified by engraved or printed labels.
•All added wiring for load runs of AWG 10, 12, 14, and 18, shall conform to MIL-W-16878/2
and/or UL1007/1569"
•All added wiring for load runs of AWG 8, shall conform to MIL-W-16878/3 and/or UL1028
•Wire terminals for added circuits must conform to MIL-T-7928. Terminals shall be insulated,
insulation grip, TYPE 11, CLASS 2 and shall be crimped with tooling recommended by the
terminal manufacturer.

•Wiring shall be protected from chafing and abrasion with convoluted polyethylene tubing (wire

becomes unavailable at the time LDV attempts to source it, LDV will provide a replacement
model with equivalent or better features, as agreed upon with the customer.

VEHICLE PURCHASE AGREEMENT WITH SAFEWARE INC.
FOR A POLICE MOBILE COMMAND CENTER
THIS AGREEMENT is made as of the day of 2024 (the
"Effective Date") by and between the CITY OF APACHE JUNCTION, an Arizona
municipal corporation ("City"), and SAFEWARE INC, a Maryland corporation,
("Supplier"), both of which may be hereinafter referred to collectively as the
"Parties".
RECITALS
A. Using American Rescue Plan Act Funds, City desires to retain a vendor
to provide a mobile command center vehicle for its police department available
through the State of Arizona Cooperative Contract#210237-C (on file in the City's
finance department) and to make payment for the same in accordance with the
terms and conditions set forth in this Agreement, including all attachments and
addenda which are appended hereto by mutual agreement of the Parties.
B. The open market procedures have been satisfied to the extent they
apply.
C. The Parties have set forth below additional terms required of Supplier
and City, including payment and delivery terms, all of which supersede any
cooperative contract terms.
AGREEMENT
NOW, THEREFORE, in consideration of the Recitals noted above, the
mutual covenants and conditions below, and other good and valuable
consideration,the receipt and sufficiency of which are hereby acknowledged,the
Parties agree as follows:
1. AGREEMENT: Supplier hereby sells, conveys and transfers to City all
rights, title and interest in and unto the vehicles, associated equipment and other
personal property, hereinafter referred to collectively as "Vehicle", detailed in
Exhibit A.
2. SUPPLIER'S DUTIES: Supplier shall provide the Vehicle and make
delivery of the Vehicle as detailed in Exhibit A, but in no case shall Vehicle be
delivered after July 31, 2026.
3. COMPENSATION: In accordance with the terms and conditions of
this Agreement, City shall compensate Supplier for Vehicle in an amount not to
exceed One Million Seven Hundred Eighty-Seven Thousand Three Hundred and
Two Dollars and Sixteen Cents ($1,787,302.16) upon delivery of the Vehicle (and
proof of title transfer to the City) and only if all Vehicle systems are operating to
the full satisfaction of the City.
4. TERM/RENEWAL: The term of this Agreement starts on
, 2024 and ends on July 31, 2026. Following the initial term, the
Parties may not renew or extend this Agreement.
5. DELIVERY AND ACCEPTANCE: Upon acceptance by the City, which
acceptance shall be identified after ten (10) calendar days of City taking
possession of titled vehicle, such acceptance shall acknowledge that the vehicle
is in good order and condition and that City is satisfied with the same.
6. WARRANTY: Contractor shall guarantee the vehicle against
defective workmanship or materials for a period of one (1)year bumper to bumper
through LDV and a five (5) year warranty on the freightliner cab/chassis.
(Warranty on file with AJPD).
7. TIME IS OF THE ESSENCE: Time is of the essence with respect to all
provisions in this Agreement. Any delay in performance by either Party shall
constitute a material breach of this Agreement.
8. APPLICABLE LAW AND VENUE: The terms and conditions of this
Agreement shall be governed by and interpreted in accordance with the laws of
the State of Arizona. Any action at law or in equity brought by either party for the
purpose of enforcing a right or rights provided for in this Agreement, shall be tried
in a court of competent jurisdiction in Pinal County, State of Arizona. The parties
hereby waive all provisions of law providing for a change of venue in such
proceeding to any other county. In the event either party shall bring suit to
enforce any term of this Agreement or to recover any damages for and on account
of the breach of any term or condition in this Agreement, it is mutually agreed that
the prevailing party in such action shall recover all costs including: all litigation
and appeal expenses, collection expenses, reasonable attorney fees, necessary
witness fees and court costs to be determined by the court in such action.
9. PROHIBITION TO CONTRACT WITH CONSULTANTS WHO ENGAGE IN
BOYCOTT OF THE STATE OF ISRAEL: The Parties acknowledge A.R.S. §§ 35-393
through 35-393.03, as amended, which forbids public entities from contracting
with consultants who engage in boycotts of the State of Israel. Should Consultant
under this Agreement engage in any such boycott against the State of Israel, this
Agreement shall be deemed automatically terminated by operation of law. Any
such boycott is a material breach of contract.
10. CERTIFICATION PURSUANT TO A.R.S. §35-394: In accordance with
Arizona Revised Statutes § 35-394, Consultant hereby certifies and agrees that
Consultant does not currently and shall notfor the duration of this Agreement use:
1) the forced labor of ethnic Uyghurs in the People's Republic of China, 2) any
services or goods produced by the forced labor of ethnic Uyghurs in the People's
Republic of China, and/or 3)any suppliers, contractors or subcontractors that use
the forced labor or any services or goods produced by the forced labor of ethnic
Uyghurs in the People's Republic of China. If Consultant becomes aware during

the term of this Agreement that Consultant is not in compliance with this Section,
then Consultant shall notify the City within five (5) business days after becoming
aware of such noncompliance. If Consultant does not provide the City with written
certification that Consultant has remedied such noncompliance within one
hundred eighty (180) days after notifying the City of such noncompliance, this
Agreement shall terminate, except that if the Agreement termination date occurs
before the end of such one hundred eighty (180) day remedy period, this
Agreement shall terminate on such contract termination date.

The Apache Junction Police Department has formally asked to use funds from
the American Rescue Plan Act ("ARPA") to purchase a Mobile Command
Vehicle ("MCV). The city auditor has approved the request to use ARPA funds
to acquire the MCV, which costs $1,787,302.16. This new MCV will replace our
current one that is over 20 years old.
Below are several key advantages offered by the MCV:
1 . Enhanced coordination and communication with internal and
external law enforcement partners.
2. On-site emergency incident management.
3. Advanced technology and equipment made available at any
location necessary.
4. Mobile crime labs and evidence processing.
5. Rapid deployment and flexibility to urban and remote areas.
6. Mobile incident command post.
7. Support for Search and Rescue Operations.
8. Public Relations and Media Management.
The primary role of a MCV is to help during active public safety emergencies
and operations, such as major criminal investigations, natural disasters, special
events, and rescue operations. MCVs serve as pivotal assets in bolstering
emergency response capabilities, facilitating enhanced communication, and
enabling efficient incident management. Their mobility and advanced
technology render them indispensable tools for public safety agencies.
The purchase of this specialty vehicle will allow the Apache Junction Police
Department to continue to be in line with other law enforcement agencies

SUBJECT: Award of Contract for Sports field lighting upgrade
Sports field and arena lighting within City of AJ Parks and Rec facilities are among some of the oldest
infrastructure in our parks. Last year, we retrofitted Prospector Park softball fields#1 . This year
we have budgeted to complete the softball complex by retrofitting fields #3 .
City staff have selected Musco lighting. They are one of the premier manufacturers for sports field
lighting, with a focus on energy-efficient, shielded LED lighting. There are several reasons why this is
the best choice for our facilities:
1. This is the same system that is at our Little League fields and Prospector Park fields #1 
and their automated system is already integrated into our facility reservation software and
additionally allows light activation by our staff from a mobile device or a computer
2. Musco has experience designing systems that are compliant with Dark Sky Friendly Sports
Field Lighting and our application with their design has already been approved by DarkSky
International
3. Over time, the city will have substantial savings through lower electrical costs and lower
maintenance/replacement costs.
This project was approved in the FY25 budget for fields#3  however, staff have also identified
potential grants to also complete the remaining sports fields at Prospector Park and Superstition
Shadows Park, utilizing our budgeted funds as a match. For this reason, staff have included a clause
in the contract that allows the city to lock in pricing for the additional projects IF the necessary
additional grant funding is received.
The City will utilize Musco's vendor, Veregy, for this replacement project under the 1 Government
Procurement Alliance (1 GPA) Cooperative Contract 22-11 PV-08 thus fulfilling procurement and open
market procedures.
Staff is recommending a construction contract be awarded to Veregy, in an amount not to exceed: One
Million Seven Hundred Eighty-Four Thousand Four Hundred Twenty-Seven Dollars and Seventy-Five
Cents ($1,784,427.75), which includes a 5% owner-controlled contingency for unforeseen
circumstances. If the city does not receive the additional grant funding, then only field #3  will be
completed this year.
This item will be presented and discussed at your July 1 st Work Session and brought back two weeks
later for consideration and approval.

Presentation is for information purposes and the opportunity for councilmembers to ask

School Resource Officer to serve at Imagine Prep Superstition.
The Arizona Department of Education has approved funding to support this
officer at the cost of $139,671 .79, which will support the officer's salaries and
benefits.
This will provide an additional officer at Imagine Prep Superstition, making a
total of six SRO in the city.

The court appreciated the opportunity during the Work Session held .tune 17, 2024, to sharewith the
Mayor and Council the updates proposed to City Code Article 4_8 Municipal Court Fee Schedule.
t this time, we respectfully request the council give direction to staff to move forward with the preparation
of an ordinance that will authorize the revision of the associated code.
For reference, a summary of the proposed amendments is shown below.-
We have 2 requests for amendment to City Code 4-8-1. The request is to amend subsections
(Administrative fee for court appointed counsel) and H (court deferred prosecution/diversion fee).,
For 4-8-1 ), public defender fees have been limited by City Code to 125 per Defendant (regardless of
the number of cases for the same defendant . This fee is years old and many courts those days have
increased the fees. Our proposal tracks Pima County :Justice Courts. We will have a chart which
determines fees based on income and the number of family members. Our request is to amend the City
Coe to make it a range of 275 to $375. Defendants would have time to,pay and are allowed to do
community service to pay their assessed fee. The court still has discretion under subsection (1)to waive
all or part of this fee based on indigence, financial hardship and the interests of justice)..
This would bring in additional revenues to help pay for the contracts of the court appointed attorneys and
the contract attorney:
The request to amend subsection l ) is kind of a housekeeping/corrective measure. For years, the
diversion fee has only been unposed can each case- not "each criminal charge for each criminal case".
[defendants doing diversion should not be treated differently based on how many charges are given to
them by the police or prosecutor. This change treats everyone;the same and confirms the current and
long-standing actual practice at the court, Attached is a copy of the City Code with the proposed
attachments. There would be no cost to the city for this change.

ARTICLE 4-8: MUNICIPAL COURT FEE SCHEDULE
Section
4-8-1 Municipal Court fee schedule
§ 4-8-1 MUNICIPAL COURT FEE SCHEDULE.
(A) Payment of costs of confinement. Any person who is convicted of a misdemeanor criminal
offense in the Municipal Court and who, as a consequence, is incarcerated in the Pinal or Maricopa
County jail or the city jail, or other city or county jail system, may as part of any sentence imposed, be
required to reimburse the City of Apache Junction for its expenses incurred for such confinement. The
cost shall take into account the announced billing practices of the Pinal or Maricopa County Sheriff or
other applicable authority as they are amended from time to time.
(B) Administrative fee for warrants for failure to comply. When the Municipal Court issues a warrant
for failure to pay a fine, restitution or any monetary obligation, or for failure to comply with a term or
condition of sentence, an administrative fee of$75 shall be imposed upon the person for who the
warrant is issued. This fee shall be added to the amount set forth in the warrant,
(C) Administrative fee for default judgments on civil traffic violation cases,

shall assess the defendant a default fee of$50 for each default judgment entered in a civil traffic
violation case upon a failure to appear or failure to pay a civil sanction, unless the default judgment is
set aside under the Rules of Procedure for Traffic Violations,
A)4 Administrative fee for court appointed counsel. The Judge has the authority to make a
reasonable determination on all cases and set a reasonable fee for the appointment of defense counsel
which will be based on a defendant's financial ability. Based on a defendant's financial ability, a Judge
shall assess a defendant an administrative fee between the range of$275 to $375. T44e4++��
(E) Municipal Court Enhancement Fund,
(1) There is hereby created a Municipal Court Enhancement Fund, which shall be used
exclusively to improve technological, operational and security capabilities of the Municipal Court.
(2) The Municipal Court Enhancement Fund shall be assessed in the base amount of$20, which
shall be applied by the Municipal Court on each civil and criminal charge where a fine, sanction,
penalty or assessment is imposed by the court. Any surcharge,fee, assessment other sum required
to be charged by state law or Arizona Supreme Court Rule as an addition to the base amount of$20
shall be imposed by the court.
(3) The Court Enhancement Fund shall be designated as a fund account, The City Finance
Director or his or her designee, shall invest the monies in the fund in the same manner as general city
funds. Interests earned on fund monies shall be deposited in the fund,
(4) The Municipal Court shall administer the fund and may make expenditures from the fund for
the purposes approved in this section.
(F) Collection fees and charges. For restitution, fines, sanctions, surcharges, assessments,
penalties, bonds, costs and fees that are forwarded to a collection agency for collection,the Municipal
Court shall assess the defendant a collection fee and charge in the amount of any fees or charges
assessed by the collection agency which is licensed under state law or authorized to pursue collection
activities in the Supreme Court of Arizona.
(G) Copying, certification,filing and other miscellaneous collection fees.
(1) The Municipal Court is authorized to collect all court-related fees and costs imposed by or
created by other ordinances, laws and statutes, such as, but not limited to, copying, certification, City
Clerk research, payment history report, notary services and check returns,
(2) Charges shall be assessed pursuant to applicable amount at the time of the service.
(H) Court deferred prosecution 1diver sion fee. A deferred prosecution fee/diversion fee in the
amount of$50 shall be imposed on each criminal case which the court defers
or diverts prosecution thereon.
fl) Authority to w live fees and costs. A magistrate may waive all or any part of any fee or cost
provided for or created by this article, giving consideration to an individual's indigence or financial
hardship and the interests of justice.
(J) Prosecution assessment recovery fee. A prosecution assessment recovery fee in the amount of
$86 shall be imposed on each criminal case and shall be applied by the Municipal Court on all criminal
cases that are prosecuted by the City Attorney's office,
(K) Probationfees.
(1) Any person accepting probation and ordered to be screened for probation qualification shall
pay the cost of such screening which, if done by the Apache Junction Municipal Court probation
monitor, shall be a fee assessed under A.R.S. §13-914(F)(3).
(2) The Municipal Court shall assess each defendant placed on court-monitored probation, a
monitoring fee of$50 a month and shall assess defendants ordered to complete education,treatment
and/or counseling a verification fee of$50.
(3) Any person, after accepting the terms of probation, who fails to appear at the time and place
set by the probation officer for an appointment with a probation officer shall be assessed a missed
appointment fee in the amount of$15,
(4) A separate collection account will be established by the City Finance Department to accrue
fees paid under this section.

required by law.
It is a time for the public to express requests, communications, comments and
suggestions.
Request to speak forms must be completed and handed to the city clerk before the
end of the city manager's report
All issues shall be presented in a professional manner without personal attacks.
Under the open meeting law the COUNCIL CANNOT ENGAGE IN DISCUSSION
on the issues presented, but may respond to criticism and may direct staff to follow
up with the speaker directly and/or place this matter on a future agenda for council
discussion.
There is a three-minute limit for each speaker.

Superstition, Inc. for a grant-funded school resource officer in the amount of
$139,671.79,for a retroactive contract term of July 15, 2024, through June 30 2029,
