HomeMy WebLinkAbout1980-02-06 City Council Regular MinutesCITY COUNCIL MINUTES REGULAR MEETING FEBRUARY 6, 1980 A Regular Meeting of the City Council of Apache Junction was held on February 6, 1980 at the Apache Junction City Hall, pursuant to the notice as required by law. CALL TO ORDER Vice -Mayor Granillo called the meeting to order at 7:02 p.m. at the Apache Junction City Hall. INVOCATION Councilman Eidson gave the Invocation. PLEDGE OF ALLEGIANCE Councilman Hill led the Pledge of Allegiance. ROLL CALL Councilmembers Present:Vice -Mayor John Granillo, Thomas Damiano, Jerry Burgess, Norman Hill, Marie Shanks, Jimmy Eidson. Councilmembers Absent :Mayor Virginia Seeman Staff Present Isabel Ballard, City Clerk Susan Goodwin, Asst. Councilman Burgess Regular Meeting - February 6, 1980 Page 2 ACCEPTANCE OF THE MINUTES OF THE REGULAR MEETING OF JANUARY 16,1980 )Councilman Eidson MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA THAT THE MINUTES OF THE REGULAR MEETING OF JANUARY 16, 1980 BE ACCEPTED AS PRESENTED. Councilman Damiano seconded the motion. VOTE:Unanimous Motion carried. AWARDS, PRESENTATIONS & COMMUNICATIONS )Vice -Mayor Granillo called upon the City Clerk to read a Resolution from the Apache Junction Republican Women. City Clerk Ballard read the Resolution. APACHE JUNCTION REPUBLICAN WOMEN:RESOLUTION WHEREAS our Apache Junction City Council was certified by govern- ing bodies as a qualifying elected body, and WHEREAS the present first Council is serving under extraordinary circumstances and spending many hours fulfilling their duties and dutifully putting forth their very best efforts to meet the needs of the electerate, and WHEREAS because of further expenditures to hold another election BE IT RESOLVED THAT THE APACHE JUNCTION REPUBLICAN WOMEN ENDORSE THE PRESENT ELECTED CITY COUNCIL OF APACHE JUNCTION. We view any recall efforts as unfounded. Presented and unanimously passed at regular meeting of Apache Junction Republican Women February 5th, 1980. Signed: Rosaline Debnam, President CALL TO THE PUBLIC )Vice -Mayor Granillo called upon Jan Hiller. Jan Hiller, 1435 N. Ironwood Drive, requested that the issuance of burning permits come before the Council. It is her feeling that it is very inconvenient and expensive to have to drive to Florence for a permit to burn and would like to see these permits issued Regular Meeting - February 6, 1980 Page 3 locally at a minimal cost. Vice -Mayor Granillo requested the Staff to check into this matter and report back to the Council. CITY MANAGER'S REPORT None PUBLIC HEARINGS ) Vice -Mayor Granill opened the Public Hearing for Ordinance No. 29, PZ-10-79, a requested zoning change by applicant Troy Church and called upon the Planning Director to brief the City Council. Planning Director Gero reported that Mr. Church's request is that the five acres located at the corner of Tomahawk Road and 4th Avenue be rezoned from General Rural to Trailer Home Site. Bob Cosby, 230 N. Winchester, representing Mr. Troy Church, spoke in favor of Ordinance No. 29, rezoning request PZ-10-79. Planning Director Gero directed several questions to Mr. Cosby regarding the fifteen acres adjacent to the five acre parcel; in particular he asked about the availability of water in this area for fire protection, and whether the present system is approved by Arizona Water Company. Mr. Cosby reported on the water system presently being used and stated that they do not have approval from Arizona Water for the fire hydrants. Planning Director Gero elaborated on several problems, i.e., the current water system, the fact that the property is in a flood zone and that there is already a surplus of T.H. Zoning; and he recommended denial of Ordinance No. 29. Vice -Mayor Granillo closed the Public Hearing. Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA THAT THE READING OF ORDINANCE NUMBER 29 BE READ BY TITLE ONLY AND THAT THE READING OF THE ENTIRE ORDINANCE BE WAIVED. the motion. VOTE: IN FAVOR: Councilman Eidson Councilman Shanks Councilman Hill Councilman Damiano Councilman Shanks seconded Regular Meeting - February 6, 1980 Page 4 OPPOSED :Councilman Burgess Vice -Mayor Granillo Motion did not pass unanimously, therefore, the reading in full of Ordinance No. 29 is required. City Clerk Ballard read as follows. ORDINANCE NO. 29, AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE ZONING MAP; REPEALING ANY CONFLICTING PROVISIONS; AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL AS FOLLOWS: Section 1:The parcel of land described as S1/2, SEk, NEk, SEk, Section 21, Township 1N, Range 8E of G and SR, B and M, be rezoned from General Rural (GR) to Trailer Homesite (TH). Section 2:All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference, are hereby repealed. Section 3:If any section, subsection, sentence, clause, phrase or portion of this ordinance or any part of the code adopted herein by reference, is for any reason held to be invalid or unconstitutional bylagadecision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION THAT ORDINANCE NO. 29, AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE ZONING MAP; REPEALING ANY CONFLICTING PROVISIONS; AND PROVIDING FOR SEVERABILITY, BE AND IS HEREBY DENIED. Councilman Burgess MOVED THAT ORDINANCE NO. 29 BE TABLED UNTIL THE STAFF CONDUCTS FURTHER RESEARCH AND SUBMITS A REPORT TO THE CITY COUNCIL. Councilman Burgess MOVED THAT ORDINANCE NO. 29 BE TABLED UNTIL THE STAFF CONDUCTS FURTHER RESEARCH AND SUBMITS A REPORT TO THE CITY COUNCIL. Councilman Hill seconded the motion. VOTE:Unanimous Motion carried. Councilman Shanks requested Staff to notify Mr. Church and Mr. Cosby of the Status of their request for rezoning, because Mr. Cosby left the meeting prior to the second motion passed on it. UNFINISHED BUSINESS (TABLED ITEMS) NEW BUSINESS )None ORDINANCE NO. 30, REZONING PZ-6-79, DEANE (FIRST READING) the City Clerk to read Ordinance No. 30 in full. read as follows. Council requested City Clerk Ballard ORDINANCE NO. 30, AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE ZONING MAP; REPEALING ANY CONFLICTING PROVISIONS; AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL AS FOLLOWS: Section 1:The parcel of land described as Lot 238 as shown on Pinal County Assessor's Map 102-07 and being located in Apache Junction, Arizona, be rezoned from General Rural (GR) to Light Industrial (C1-1). Section 2:All ordinances and parts of ordinances in conflict with the Regular Meeting - February 6, 1980 Page 6 provisions of this ordinance or any part of the code adopted herein by reference, are hereby repealed. Section 3:If any section, subsection, sentence, clause, phrase or portion of this ordinance or any part of the code adopted herein by reference, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. CAAG, HUMAN RESOURCES COMMITTEE )Councilman Shanks reported that the CAAG, Human Resources Committee requires one City Councilmember on their committee and have asked Councilman Shanks to serve in this capacity, however, she must have the approval of the City Council to do so. Councilman Shanks also requested that Staff, upon the approval of the Council, write a letter to the County Board of Supervisiors, Regional Council and CAAG, Human Resources Department to confirm that she will serve on the committee. Councilman Burgess MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION THAT COUNCILMAN MARIE SHANKS BE AND IS HEREBY APPOINTED AS APACHE JUNCTION'S LOCAL GOVERNMENT REPRESENTATIVE ON THE CENTRAL ARIZONA ASSOCIATION OF GOVERNMENTS, HUMAN RESOURCE COMMITTEE, IN COMPLIANCE WITH THE REGIONAL COUNCIL REQUIREMENTS FOR LOCAL GOVERNMENT PARTICIPATION. CLAIMS )Councilman Damiano read a letter form the Director of Public Works, regarding the purchase of a 1970 dump truck and his recommendation of this purchase. Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION THAT THE PURCHASE OF A 1970 DUMP TRUCK IN THE AMOUNT OF $6500 PURSUANT TO THE CITY'S GOALS AND OBJECTIVES FOR FISCAL YEAR 1979-80, BE AND IS HEREBY RATIFIED. the motion. EXECUTIVE SESSION, FEBRUARY 20, 1980, 6:00 P.M.) )Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA THAT AN EXECUTIVE SESSION REGARDING PERSONNEL BE HELD ON THE 20th DAY OF FEBRUARY, 1980, 6:00 P.M. Councilman Hill seconded the motion. VOTE:Unanimous Motion carried. INFORMATION AND REPORTS ) )There was a discussion regarding the present Uniform Building Code and some of the problems it presents. Jerome Kowal and Sons Plumbing, P.O. Box 1095, Apache Junction, reported that the Building Inspector had approved to vents which are in violation of the current code and yet has directed him to change his vent to meet the codes. Public Works Director Broman reported that if Mr. Kowal would submit his comments on the matter in writing to the Building Official as to the violations and what his recommendations may be, he will work with him to clear up this problem.
