4. 25-116 Consideration of award of contract to Viasun Corporation for the
construction of curbing for the Apache Trail medians between Ocotillo
Drive and approximately 1/2 mile west. The work would be through
Pinal County cooperative job order contract No. 175623 in the amount
of$469,237.04 plus a 10% contingency for unforeseen change orders
in the amount of$46,923.70 for a total project cost not to exceed
$516,160.74. Work will result in curbing to facilitate roadway drainage
and protection to the next phase of median beautification
improvements. Work is planned to take place in April and May 2025.

M. CALL TO PUBLIC
At this time the public has the privilege to address the council with requests, communications, comments
or suggestions relating to city business.All speakers must have already submitted a written "Request to
Speak"form to the city clerk no later than the conclusion of the city manager's report portion of the
agenda. If there is a group speaking on the same item, they should select a spokesperson.All such
remarks shall be addressed to the council as a whole and not to any member thereof. The mayor is
authorized to ask a speaker to stop speaking and leave the podium or to adjourn the meeting if anyone
becomes disorderly, uncivil, makes personal attacks or continues to speak about items that are not
within the jurisdiction of the city after being warned such issues are beyond the jurisdiction of the city to
act. The council may not answer questions of the speaker, discuss the matter with one another, but may,
at the conclusion: 1)respond to criticism by a speaker, 2)ask the city manager to review a matter, 3)
ask the city manager to place the matter on a future agenda. Each speaker must approach the podium,
speak into the microphone,provide their name and address. There is a three(3)minute time limit per

Councilmember Cross thanked the community and Police Department for supporting the Pony
Express re-enactment.
Mayor Wilson stated that Arizona State Representative Marshall enjoyed attending the Lost
Dutchman Days parade and rodeo. He shared some photos of the events.
Mayor Wilson also spoke about the Junior Livestock Program and encouraged the community to
support the local 4H group.
Councilmember Heck shared the success of the 61 st Annual Lost Dutchman Days events and
thanked volunteers and city staff that helped make the event run smoothly. He stated the
marathon had 2,800 participants and how the events have helped the city become a more
recognized center of activity.
G. CITY MANAGER'S REPORT
6. 25-049 City Manager's Report
City Manager Bryant Powell thanked City staff for their help and participation in the Lost
Dutchman Days events.
7. 25-087 Legislative Update
Management Analyst Rob Wisler presented an overview of the Transaction Privilege Tax(TPT)
that Arizona uses for business activity and the timeline of the HCR 2021 Legislative Bill which
originally was introduced to eliminate the ability for municipalities to impose the TPT on retail

sales of all food for home consumption. The bill was amended to allow municipalities who
currently impose the TPT on retail food to continue to implement it at a rate of 2%. Increases
would not be permitted. He also went over the impact to the City if this bill passes.
Councilmembers concerns included if this type of bill has been proposed prior, other cities
being in debt that do not charge TPT on retail food, and how this bill will hurt the community.
Mr. Wisler responded to all concerns.
8. 2 -097 AJPD Update
Police Chief Michael Pooley presented the following updates on the Apache Junction Police
Department for 2024:
- Increase in hiring and recruitment-they are fully staffed with a waiting list
-Added technology-Overt Camera Trailers, Motorola APX N70 Radios, VirTra simulation
training, Peregrine, UAS Team, Flock Safety, and SPIDR Tech
-Special Events-70+community events
- New beat system
- Increase in calls for service
- Homeless outreach with a dedicated officer
Councilmembers complimented Chief Pooley on a job well done by bringing these updates to
the department and keeping the community safe. He also highlighted the recent large operation
that targeted online predators.
9. 25-050 Announcement of Current Events
Management Analyst Eli Richardson shared that the Apache Junction Water District(AJWD)
and Arizona Water Company (AWC) have partnered with the Boyce Thompson Arboretum to
give away 2 free plants per household for AJWD customers. This event is on March 8, 2025,
from 8:00 a.m. to 4:00 p.m. and a valid ID and utility bill is required.

10. 25-096 Presentation, discussion and consideration of Resolution No. 25-03 a
resolution of the mayor and city council of the City of Apache Junction,
Arizona ("Apache Junction"), located in the counties of Maricopa and
Pinal, calling and ordering a special election in each county to be held on
November 4, 2025, for the purpose of submitting to the qualified electors
of Apache Junction the question of changing the mayoral term of office
from two years to four years.
Councilmember Johnson moved,seconded by Councilmember Nesser that Resolution No.25-03,a
resolution of the Mayor and City Council of the City of Apache Junction,Arizona, located in the
counties of Maricopa and Pinal,calling and ordering a special election in each county to be held
on November 4,2025,for the purpose of submitting to the qualified electors of Apache Junction
the question of changing the mayoral term of office from two years to four years be approved.

City Attorney Joel Stern presented Resolution 25-03 which calls for the election on November 4,
2025, and changing the City Code regarding the Mayoral term from 2 years to 4 years.

11. 25-079 As required by Apache Junction City Code, Volume I, Chapter 3,
Administration, Article 3-2, Department of City Clerk, §§ 3-2-1(13)(2) and
3-2-4, the city manager is seeking ratification of Evie McKinney for
appointment to the position of City Clerk.
Councilmember Cross moved,seconded by Councilmember Nesser to ratify the appointment of
Evie McKinney to the position of City Clerk.

City Manager Bryant Powell presented Evie McKinney for ratification for City Clerk. He shared
her years of service and gave his support.
Ms. McKinney thanked City Management and the Council for their support over the last few
months. She introduced the Clerk's department and shared memories of her years of service
with the City. She also stated the importance of maintaining a good relationship with the Mayor
and Council and shared her goals for the Clerk's department.

City staff respectfully requests city council consideration of award of contract to Viasun
Corporation for project PWC2019-13E for the installation of curbing for the Apache Trail
medians between Ocotillo Drive and approximately 1/2 mile to the west for a not to exceed
amount including 10% contingency for unforeseens of $516,160.74. This is the last phase and
will complete the multi-year installation of median curbs from Meridian Dr. to Idaho Road.
This work was discussed with council at the July 16, 2024 City Council regular session under
Public Works' "Fiscal Year 2025 CIP & Street Maintenance Plan." The work involves the
construction of cement concrete curbs around the medians to facilitate roadway drainage and
protect landscape improvements planned for the median areas. The work would last for about
three weeks planned for in the months of April and May 2025. Work would occur during the
daytime hours only with limited impacts to vehicular traffic lanes and no impacts expected to
adjacent business entrances.

In the interim between the resignation of his predecessor and the appointment of
Presiding Magistrate Thomas McDermott, the municipal court was, at certain times, unable to
secure adequate coverage by judicial officers who met the qualifications as set forth under
Apache Junction City Code § 5-1-4. Ensuring adequate coverage is a top priority for the court.
An expanded pool of associate magistrates will be necessary, especially for times when the
Presiding Magistrate is away at mandatory training, on a scheduled vacation, or falls ill
unexpectedly.
To that end, the Presiding Magistrate respectfully requests that the council approve
associate magistrate contracts for the following individuals, all of whom are qualified under
A.J.C.C. §5-1-4:

AGREEMENT WITH MICHAEL KIELSKY FOR APACHE JUNCTION MUNICIPAL
COURT ASSOCIATE MAGISTRATE SERVICES
THIS AGREEMENT is made as of the day of 2025 (the
"Effective Date") by and between CITY OF APACHE JUNCTION, an Arizona
municipal corporation ("City") and MICHAEL KIELSKY ("Contract Judge"), both
of which may be hereinafter referred to individually as a "Party" or collectively
as the "Parties".
RECITALS
A. City desires to establish a rotation list of associate magistrates on an
as-needed basis for municipal court judicial services and to make payment for
the same in accordance with the terms and conditions set forth in this
Agreement, including all attachments and addenda which are appended hereto
by mutual agreement of the Parties.
B. Judicial appointments are categorically exempt from the open market
recruitment/procurement procedures pursuant to Apache Junction City Code
("A.J.C.C.") Vol. 1, § 3-7-7(A), however, pursuant to A.J.C.C., Vol 1, § 5-1-2,
associate magistrates must be appointed by the mayor and city council.
C. The Parties have set forth below the contemplated services that will be
provided to the City and the payment terms for such services.
AGREEMENT
NOW, THEREFORE, in consideration of the Recitals noted above, the
mutual covenants and conditions below, and other good and valuable
consideration, the receipt and sufficiency of which are hereby acknowledged,
the Parties agree as follows:
1. ASSOCIATE MAGISTRATE DUTIES: City hereby agrees to hire
Contract Judge to perform the functions and duties specified in the Apache
Junction City Code, Volume 1, Chapter 5: Municipal Court, Article 5-1: Municipal
Cour , on an as-needed basis, and Contract Judge agrees to perform the duties
as further detailed in Exhibit A.
2. TERM/RENEWAL:
A. This Agreement shall be effective from March 19, 2025
through June 30, 2028 (the "Term") unless otherwise terminated as set
forth herein.
B. Nothing in this Agreement shall prevent, limit or otherwise
interfere with the right of City to terminate the services of Contract Judge
as provided by state law.
C. Nothing in this Agreement shall prevent, limit or otherwise
interfere with the right of Contract Judge to terminate this agreement at
any time subject only to the provisions set forth in Section 3.
3. TERMINATION: In the event Contract Judge terminates this
agreement before expiration of the aforesaid Term, Contract Judge shall
provide City thirty (30) calendar day written advance notice.
4. SALARY: City agrees to pay Contract Judge for his/her services
rendered pursuant hereto at hourly rate of Sixty Dollars and Zero Cents ($60.00)
but in no case shall Contract Judge work more than thirty (30) hours per week.
5. HOURS OF WORK:
A. Hours Monday - Friday. Contract Judge shall work on an as-
needed basis and shall be on a rotation list with other associate
magistrates.
B. Weekend Hours. Contract Judge will provide services as
needed on weekends as directed by the presiding magistrate.
C. Hours of Work. It is recognized that Contract Judge may be
,required to routinely work outside traditional business hours as directed
by the presiding magistrate.
6. INDEPENDENT CONTRACTOR: The Parties agree and understand
that Contract Judge is acting in the capacity of an independent contractor and
not a city employee with city benefits.
7. GENERAL PROVISIONS:
A. The text herein shall constitute the entire Agreement between
the Parties.
B. This Agreement shall be binding upon and inure to the benefit
of the heirs at law and executors of Contract Judge.
C. If any provisions or any portion hereof contained in this
Agreement is held to be unconstitutional, invalid or unenforceable, the
remainder of this Agreement, or portion thereof, shall be deemed
severable, shall not be affected, and shall remain in full force and effect.
8. NOTICES: All notices required under this Agreement shall be in
writing and shall be sent by first class U.S. certified mail, postage prepaid,

MUNICIPAL COURT ASSOCIATE MAGISTRATE SERVICES
THIS AGREEMENT is made as of the day of 2025 (the
"Effective Date") by and between CITY OF APACHE JUNCTION, an Arizona
municipal corporation ("City") and DAI TRANG (LIZ) NGUYEN ("Contract
Judge"), both of which may be hereinafter referred to individually as a "Party" or
collectively as the "Parties".
RECITALS
A. City desires to establish a rotation list of associate magistrates on an
as-needed basis for municipal court judicial services and to make payment for
the same in accordance with the terms and conditions set forth in this
Agreement, including all attachments and addenda which are appended hereto
by mutual agreement of the Parties.
B. Judicial appointments are categorically exempt from the open market
recruitment/procurement procedures pursuant to Apache Junction City Code
("A.J.C.C.") Vol. 1, § 3-7-7(A), however, pursuant to A.J.C.C., Vol 1, § 5-1-2,
associate magistrates must be appointed by the mayor and city council.
C. The Parties have set forth below the contemplated services that will be
provided to the City and the payment terms for such services.
AGREEMENT
NOW, THEREFORE, in consideration of the Recitals noted above, the
mutual covenants and conditions below, and other good and valuable
consideration, the receipt and sufficiency of which are hereby acknowledged,
the Parties agree as follows:
1. ASSOCIATE MAGISTRATE DUTIES: City hereby agrees to hire
Contract Judge to perform the functions and duties specified in the Apache
Junction City Code, Volume 1, Chapter 5: Municipal Court, Article 5-1: Municipal
Cour , on an as-needed basis, and Contract Judge agrees to perform the duties
as further detailed in Exhibit A.
2. TERM/RENEWAL:
A. This Agreement shall be effective from March 19, 2025
through June 30, 2028 (the "Term") unless otherwise terminated as set
forth herein.
B. Nothing in this Agreement shall prevent, limit or otherwise
interfere with the right of City to terminate the services of Contract Judge
as provided by state law.
C. Nothing in this Agreement shall prevent, limit or otherwise
interfere with the right of Contract Judge to terminate this agreement at
any time subject only to the provisions set forth in Section 3.
3. TERMINATION: In the event Contract Judge terminates this
agreement before expiration of the aforesaid Term, Contract Judge shall
provide City thirty (30) calendar day written advance notice.
4. SALARY: City agrees to pay Contract Judge for his/her services
rendered pursuant hereto at hourly rate of Sixty Dollars and Zero Cents ($60.00)
but in no case shall Contract Judge work more than thirty (30) hours per week.
5. HOURS OF WORK:
A. Hours Monday -Friday. Contract Judge shall work on an as-
needed basis and shall be on a rotation list with other associate
magistrates.
B. Weekend Hours. Contract Judge will provide services as
needed on weekends as directed by the presiding magistrate.
C. Hours of Work. It is recognized that Contract Judge may be
required to routinely work outside traditional business hours as directed
by the presiding magistrate.
6. INDEPENDENT CONTRACTOR: The Parties agree and understand
that Contract Judge is acting in the capacity of an independent contractor and
not a city employee with city benefits.
7. GENERAL PROVISIONS:
A. The text herein shall constitute the entire Agreement between
the Parties.
B. This Agreement shall be binding upon and inure to the benefit
of the heirs at law and executors of Contract Judge.
C. If any provisions or any portion hereof contained in this
Agreement is held to be unconstitutional, invalid or unenforceable, the
remainder of this Agreement, or portion thereof, shall be deemed
severable, shall not be affected, and shall remain in full force and effect.
8. NOTICES: All notices required under this Agreement shall be in
writing and shall be sent by first class U.S. certified mail, postage prepaid,
return receipt requested, addressed to the following Parties:

Re: Meeting Agenda Item: Request for Juvenile Hearing Officer Appointments
Pursuant to A.R.S. § 8-323(A), the municipal court may hear and adjudicate juvenile
delinquency actions for certain misdemeanor offenses. This statute helps to preserve city law
enforcement resources by eliminating the need to prepare the time-consuming petition that
must be filed to initiate a delinquency action in superior court and by reducing transportation
costs.
The presiding magistrate respectfully requests that the council, acting as the "local
governing body," pursuant to A.R.S. § 8-323(A), approve Presiding Magistrate Thomas C.
McDermott and Associate Magistrates Michael Kielsky, Dai Trang ("Liz") Nguyen, Cody
Weagant,Megan Weagant, and Geraldine Roll as juvenile hearing officers.

BACKGROUND
On October 5, 2021, the City of Apache Junction approved the
Auction Property at Superstition Vistas Master Planned Community
plan.
Most recently Lennar Arizona, LLC. has submitted a preliminary
plat for Blossom Rock - Parcel 8, which has been
administratively approved by Staff (the "Subdivision Committee"
per the MPC) . Staff has found the proposed final plat to be in
conformance with the preliminary plat, the Auction Property at
Superstition Vistas Master Planned Community plan and the
Superstition Vistas Master Infrastructure Reports .
PROPOSALS
The Final Plat proposes approval of a 575-lot residential
subdivision with typical lot sizes ranging from
3, 675 square feet to 5, 625 square feet.
The property is generally located on the northwest corner of
Ironwood Drive and Warner Avenue . Primary community entrances
are proposed to be located via Warner Avenue .
PLANNING STAFF ANALYSIS
Relationship to General Plan:
The subject site is designated by the city' s General Plan as
"Master Planned Community" . The proposed density of
approximately 4 . 58 du/acre is consistent with the City of Apache
Junction' s General Plan and density limits as established by the
Auction Property at Superstition Vistas Master Planned Community
plan.
Infrastructure Improvements:
Road improvements and necessary utility infrastructure
improvements will be built and dedicated to the city prior to
the final inspection and approval of any individual residential
lots .
Furthermore, all other necessary on-site improvements, such as
community amenities, retention basins, accessible routes, and
landscape buffers, will be built during the first phase of on-
site construction.

PLANNING DIVISION RECOMMENDATION
Staff is supportive of the proposed Final Plat for Blossom Rock
- Parcel 8, because of its conformance with the preliminary
plat, the Auction Property at Superstition Vistas Master Planned
Community plan and the Superstition Vistas Master Infrastructure
Reports and respectfully recommends to the City Council to
approve such request.

TEEN DATING VIOLENCE AWARENESS
WHEREAS, each year in the U.S.,nearly 1.5 million high school students
nationwide experience physical abuse from a dating partner; and
WHEREAS,, in the U.S., I in 3 teens will experience physical,sexual or emotional
abuse; and
WHEREAS,, only 33%of teens who were in an abusive relationship ever told
anyone; and
WHEREAS, teens who suffer dating abuse are subject to long-term consequences
like alcoholism, eating disorders, promiscuity, thoughts of suicide,
and violent behavior; and
WHEREAS, the City of Apache Junction and the community must work
together to ensure the safety of our teens and create a
world where every teen can live free of dating violence

VIETNAM WAR VETERANS DAY
MARCH 29, 2025
WHEREAS, today we honor those who bravely served in the Vietnam War and
who sacrificed, as did their families, on behalf of our Nation; and
WHEREAS, fifty-two years ago, on March 29, 1973, the last 2,500 American
troops were withdrawn from South Vietnam, ending military
involvement in what is now the longest war in our country's
history; and
WHEREAS, more than 600 men and women from the great State of Arizona
made the ultimate sacrifice in the defense of our country during
war; and
WHEREAS., in the spirit of pride and gratitude, it is time to honor the heroic
accomplishments of the 58,000 service men and women whose
names are listed on the Vietnam Memorial Wall; and
WHEREAS, it is important that those who served are honored with recognition
and to ensure that their great sacrifices and immeasurable
contributions to our nation are never forgotten.

RESOLUTION NO. 25-04
A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION, ARIZONA, URGING THE STATE
LEGISLATURE OF THE STATE OF ARIZONA TO RESPECT LOCAL
MUNICIPAL GOVERNMENT INDEPENDENCE AND TO REFRAIN FROM
ADOPTING LAWS THAT NEGATIVELY IMPACT MUNICIPAL FINANCES .
WHEREAS, the mayor and city council ("city council") of the
City of Apache Junction ("City") is elected by its voters to
represent and exercise their will and determine the policy
direction of the community; and
WHEREAS, the general plan of the City is approved by its
voters to guide the development of the community; and
WHEREAS, local regulations are necessary to mitigate
nuisances and threats to the public health, safety and welfare of
individuals and properties; and
WHEREAS, it is well-established that local governments
provide critical public safety services and essential community
services such as libraries, parks and recreation, and
transportation infrastructure; and
WHEREAS, those services are reliant on limited revenue
sources; and
WHEREAS, the city council, acting on the will of the voters
and under state law and the model city tax code, is empowered to
set transaction privilege tax ("TPT") rates; and
WHEREAS, the Arizona State Legislature ("state legislature")
passed SB 1131 in 2023, preventing municipalities from charging
TPT on residential rentals within communities; and
WHEREAS, the City lost approximately $1 . 5 Million per year
when the state legislature passed and implemented SB 1131; and
WHEREAS, the state legislature recently wrote House
Concurrent Resolution ("HCR") 2021, which if successful in a
statewide election will prevent municipalities from charging the
TPT on retail sales of food for home consumption; and
WHEREAS, the City charges 2 . 4% on retail sales of food for
home consumption; and

WHEREAS, the City will lose approximately $3 . 5 million per
year if the voters of Arizona approve it in November 2025; and
WHEREAS, the continued assault on City revenue sources by the
state legislature makes it possible that the City will be unable
to provide for essential public services; and
WHEREAS, the state legislature passed SB 1350 in 2016,
preventing municipalities from regulating short-term rentals; and
WHEREAS, the state legislature passed HB 2720 in 2024,
preventing municipalities from regulating accessory dwelling
units/casitas on single family lots; and
WHEREAS, the state legislature threatens to pass HB 2371 and
SB 1229, preventing municipalities from administering their
single-family zoned lots and eliminating their ability to
establish lot sizes, design standards, and neighborhood
characteristics, all of which are guided by municipality voters in
their general plans .
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF APACHE JUNCTION ARIZONA, AS FOLLOWS :
The mayor and city council urge the state legislature to respect
local control and stop the endless assault on city and town local
government control relating to zoning and funding.

I would like to call this City of Apache Junction Council Meeting of March 18, 2025, to
order and ask everyone to put their cell phones on silent.

1. Consideration of acceptance of agenda.
2. Consideration of approval of minutes of the regular meeting of March 4, 2025.
3. Consideration of approval of Resolution No. 25-02, a Resolution of the Mayor and
City Council of the City of Apache Junction, Arizona, designating Angelie Hawley the
Chief Fiscal Officer for officially submitting and certifying the accuracy of fiscal year
2026 expenditure limitation report to the Arizona Auditor General.
4. Consideration of award of contract to Viasun Corporation for the construction of
curbing for the Apache Trail medians between Ocotillo Drive and approximately Y2
mile west. The work would be through Pinal County cooperative job order contract
No. 175623 in the amount of $469,237.04 plus a 10% contingency for unforeseen
change orders in the amount of $46,923.70 for a total project cost not to exceed
$516,160.74. Work will result in curbing to facilitate roadway drainage and
protection to the next phase of median beautification improvements. Work is
planned to take place in April and May 2025.
5. Presentation, discussion and consideration of approval of municipal court associate
magistrate agreements,
6. Presentation, discussion and consideration of approval of request for juvenile
hearing officer appointments.
7. Consideration of approval of the final Plat for Blossom Rock— Parcel 8 in order to
facilitate a 575-lot residential subdivision consisting of approximately 125-acres
zoned Master Planned Community (MPC).

Under the open meeting law the COUNCIL CANNOT ENGAGE IN DISCUSSION on the
issues presented, but may respond to criticism and may direct staff to follow up
with the speaker directly and/or place this matter on a future agenda for council
discussion.
There is a three-minute limit for each speaker.
