HomeMy WebLinkAboutRES 01-12RESOLUTION NO.01-12 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,APPROVING THE PRELIMINARY SUBDIVISION PLAT FOR VALDEZ COMMERCIAL SUBDIVISION,CASE SD -5-01,BY EDDIE AND VIVIAN VALDEZ,FEEDBAG RESTAURANT INCORPORATED AND THOMPSON REAL ESTATE INCORPORATED. WHEREAS,the subdividers in case SD -5-01 propose to subdivide approximately 6.27 net acres in the Southeast quarter area of Section 20,Township One North,Range Eight East of the Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona,into six (6)commercial lots pursuant to Arizona Revised Statutes (A.R.S.),Title 9,Chapter 4,Article 6.2,and pursuant to the Apache Junction City Code,Volume II,Land Development Code, Chapter 2,Subdivision Regulations;and WHEREAS,the Apache Junction Planning and Zoning Commission held a public hearing regarding the preliminary plat for SD -5-01 on June 26,2001,and recommended approval of SD -5-01 by a vote of 4-0;and WHEREAS,this Council finds this proposed subdivision to be in compliance with the "Employment/Retail"designation of the Apache Junction General Plan;and WHEREAS,this Council finds this proposed subdivision to be in compliance with the Apache Junction City Code,Volume II,Land Development Code,Chapter 1, Zoning Ordinance,and the Apache Junction City Code,Volume II,Land Development Code,Chapter 2,Subdivision Regulations;and WHEREAS,this Council finds that the Conditions of Approval required for this subdivision are necessary for sound and orderly community development,for preservation of community values and for the promotion of the general health, safety,convenience and welfare of the citizens of Apache Junction. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that: Said preliminary subdivision plat for Valdez Commercial Subdivision.case SD- 5 -01,be approved subject to the following conditions of approval: RESOLUTION NO.01-12 PAGE 1 OF 3 1.The subdividers shall provide for any necessary on -site and off -site improvements as required by the City Engineer,including,but not necessarily limited to,the installation of streetlights along S.Phelps Drive. 2.The plats shall show that all of the parking and internal drive areas shall be dedicated as perpetual easements for ingress/egress,parking, drainage and utility purposes,for the benefit of all of the end users of the subdivision. 3.All lots shall be improved with parking lot landscaping around individual buildings and in water retention areas,to be reviewed and approved by the Department of Development Services Planning Division. Masonry separation walls shall not be required between lots for the purpose of traffic and drainage flow,and mutual cross access. 4.The subdivision property owners shall continue to work with the property owners to the north to create an additional access way,just north of the Valdez Commercial Subdivision,for the benefit of both developments and the general public. 5.Subsequent to subdivision approval,the property owners shall proceed through the Conditional Use Permit process to provide a multi -tenant sign and other signage as needed,for the commercial subdivision.
