HomeMy WebLinkAboutRES 01-15RESOLUTION NO.01-15 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AUTHORIZING THE CREATION OF A TWENTY-EIGHT FOOT (28')WIDE PRIVATE ACCESS WAY PURSUANT TO THE APACHE JUNCTION CITY CODE,VOLUME II,LAND DEVELOPMENT CODE,CHAPTER 1,ZONING ORDINANCE,ARTICLE 20 PARKING.LOADING.AND INTERIOR OR PRIVATE STREET STANDARDS,SECTION 20.0108 PRIVATE ACCESS WAY STANDARDS,IN CASE PA -1-01,FOR THE PURPOSE OF PROVIDING LEGAL ACCESS TO CERTAIN PROPOSED TH (TRAILER HOMESITES)-ZONED PARCELS DESCRIBED HEREIN. WHEREAS,a perpetual Private Access Way described as follows: The South 28 feet of the West 158 feet of the North 156 feet of the following described parcel: The West half of the Northeast quarter of the Northwest quarter of the Northwest quarter of Section 30,Township One North,Range Eight East of the Gila and Salt River Base and Meridian,Pinal County,Arizona;EXCEPT the West 130 feet of the South 504 feet;EXCEPT the South 264 feet;and EXCEPT the North 50 feet and the West 30 feet thereof; has been requested in Case PA -1-01;and WHEREAS,said Private Access Way is for the benefit of providing perpetual right of ingress and egress for access and utilities for the proposed parcels described as follows: PARCEL "A":The West 130 feet of the North 156 feet of the West half of the Northeast quarter of the Northwest quarter of the Northwest quarter of Section 30,Township One North,Range Eight East of the Gila and Salt River Base and Meridian,Pinal County,Arizona;EXCEPT the West 130 feet of the South 504 feet;EXCEPT the South 264 feet;and EXCEPT the North 50 feet and the West 30 feet thereof;and PARCEL "B":The West half of the Northeast quarter of the Northwest quarter of the Northwest quarter of Section 30,Township One North,Range Eight East of the Gila and Salt River Base and Meridian,Pinal County,Arizona;EXCEPT the South 264 feet;EXCEPT the West 130 feet;and EXCEPT the North 50 feet thereof;and RESOLUTION NO.01-15 PAGE 1 OF 3 WHEREAS,the creation of the Private Access Way is necessary to provide legal access to the above described parcels;and WHEREAS,on June 26,2001,the City of Apache Junction Planning and Zoning Commission,after holding a public hearing,did recommend approval of the Private Access Way;and WHEREAS,satisfactory evidence has been received to indicate that the requested Private Access Way does not present a potential hazard to vehicular and/or pedestrian traffic;and WHEREAS,the requested Private Access Way would not be detrimental to the public health,safety and welfare. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that the Private Access Way,as described above, be approved subject to the following conditions: 1.The property owners shall dedicate to the City,for roadway and utility purposes,any necessary adjacent rights -of -way as determined by the City Engineer,including the north 50 feet for W.Broadway Avenue,the west 30 feet for S.Cedar Drive,and a 20 -foot by 20 -foot cutoff corner at the intersection of said roadways. 2.The property owners shall proceed through the City's Land Split Map process prior to the creation of their proposed new lot.Said new lot at the southeast corner of Broadway and Cedar shall be a minimum of 10,400 net square feet in size and its configuration,and any buildings proposed to be located thereon,shall comply with TH zone and other applicable requirements. 3.A recordable document providing perpetual right of ingress and egress for access and utility purposes,for the benefit of the easternmost parcel,shall be executed by the property owners subsequent to or concurrent with the approval of the Land Split Map described in Condition #2 above. 4.Both resultant lots of the proposed Land Split shall be addressed on S. Cedar Drive and appropriate address signage shall be provided on the new lot site and at the entrance of the private access way for the existing residence. RESOLUTION NO.01-15 PAGE 2 OF 3 5.The property owners shall construct or pay for the construction of full street improvements along their portion of S.Cedar Drive according to the City Engineer's standards.The City of Apache Junction shall construct the street improvements on W.Broadway Avenue adjacent to the subject property (including the 20 -foot by 20 -foot corner)and shall pave the 28 -foot -wide by 128 -foot -long private access way,as specified by the City Engineer and as allowed by the City Council. 6.A one foot (1')wide vehicular non -access easement shall be recorded along the property's Broadway Avenue frontage.
