A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,ACCEPTING A DEDICATION OF LAND AND EASEMENTS TO THE
CITY OF APACHE JUNCTION INCLUDING PORTIONS OF THIRTY-SIX PARCELS
IDENTIFIED UNDER PINAL COUNTY ASSESSOR'S PARCEL NUMBERS 101-08-072,.

WHEREAS,to further public improvement ,projects,the City must obtain certain
sections of right-of-way along Broadway Avenue.Ironwood Drive,Superstition
Boulevard.Ocotillo Drive,Saguaro Drive,Phelps Drive.and Southern Avenue:
and
-WHEREAS,each property owner (-property owner -)of the property in question
has agreed to dedicate to the City of Apache Junction ("City")the property
legally described in the attached deeds:and
WHEREAS,and the City desires to accept such dedication for public purposes:
WHEREAS.each property owner acknowledges that such property being dedicated
is free of all liens or encumbrance.,-.and as authorized by other interested
parties of record holding any and all liens and encumbrances:and
NOW. -THEREFORE.BE IT RESOLVED by the Mayor and City Council of the City of
Apache.Arizona.that the City hereby accepts the dedication of land as
evidenced by an appropriate document executed by the Mayor,a copy of which
shall be filed by the City Clerk in the Recorder's Office of Pinal County,
PASSED AND ADLOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,THIS 16TH DAY OF OCTOBER .2001.

DEED OF PARTIAL RELEASE AND PARTIAL RECONVEYANCE
Beneficiary
WHEREAS, an indebtedness secured by the Deed of Trust executed by Frank R. Gamboa and Rosa
Gamboa,husband and wife, to Waterfield Financial Corporation,Trustee, dated May 30, 1996, was
recorded on May 31, 1996 as Fee No. 1996-019010 in the Records of Pinal County, Arizona; and
WHEREAS,Union Federal Savings Bank of Indianapolis,a Federal Savings Bank, is the Beneficial
interest in said Deed of Trust; and,
WHEREAS, a portion of the indebtedness has been satisfied.
NOW, THEREFORE, pursuant to the provisions of Arizona Revised Statutes 33-707.A which make it
unnecessary for the Trustee to join in this document, the Beneficiary under said Deed of Trust does
hereby release and reconvey, without covenant or warranty, express or implied, unto the parties legally
entitled thereto all rights, title and interest, which was heretofore acquired by said Trustee under said
Deed of Trust, for the benefit of the Beneficiary, in and to that portion of the property legally described
in Exhibit "A"and depicted in Exhibit "B"attached hereto and incorporated by reference herein.
The remaining property described in said Deed of Trust shall continue to be held by Trustee under the
terms thereof, and, as provided therein, this Partial Reconveyance does not affect the personal liability
of any person for payment of the indebtedness secured thereby.
IN WITNESS THEREOF, Beneficiary has executed this Deed of Partial Release and Partial

WHEREAS, an indebtedness secured by the Deed of Trust executed by Thomas E. Williams II and
Sandra D. Williams,Trustors, to Equitable Deed Company,Trustee, dated July 22, 1996, was recorded
on July 26, 1996 as Fee No. 1996-025568, and re-recorded on August 7, 1997 as Fee No. 1997-027225
in the Records of Pinal County, Arizona; and
Bank of America,N.A.fka Bank of America NT & SA successor by merger to
WHEREAS,Bank of America, Arizona,is the Beneficial interest in said Deed ot 1rust; and,
WHEREAS, a portion of the indebtedness has been satisfied.
NOW, THEREFORE, pursuant to the provisions of Arizona Revised Statutes 33-707.A which make it
unnecessary for the Trustee to join in this document, the Beneficiary under said Deed of Trust does
hereby release and reconvey, without covenant or warranty, express or implied, unto the parties legally
entitled thereto all rights, title and interest, which was heretofore acquired by said Trustee under said
Deed of Trust, for the benefit of the Beneficiary, in and to that portion of the property legally described
in Exhibit "A"and depicted in Exhibit "B"attached hereto and incorporated by reference herein.
The remaining property described in said Deed of Trust shall continue to be held by Trustee under the
terms thereof, and, as provided therein, this Partial Reconveyance does not affect the personal liability
of any person for payment of the indebtedness secured thereby.
