HomeMy WebLinkAboutRES 01-11RESOLUTION NO.01-11 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,APPROVING PRELIMINARY SUBDIVISION PLAT,CASE NO.SD -4-01,SONORAN WELLS,BY HEC ENGINEERING,REPRESENTED BY MASON LUNDELL. WHEREAS,the subdivider in Case SD -4-01 proposes to subdivide ten gross acres in the Northeast quarter area of Section 29,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Pinal County,Arizona,into 33 residential lots,pursuant to Arizona Revised Statutes Annotated ("A.R.S.")Title 9,Chapter 4,Article 6.2,and pursuant to the Apache Junction City Code,Volume II,Land Development Code,Chapter 1,Zoning Ordinance,Section 15.0400,CR-3 Single Family Residence Zone,and Chapter 2,Subdivision Regulations:and WHEREAS,on June 19,2001,the Mayor and City Council approved Ordinance No.1152 which rezoned the subject property from GR (General Rural Zone)to CR-3 (Single Family Residence Zone)by a vote of 7-0: and WHEREAS,on April 24,2001,the Apache Junction Planning and Zoning Commission held a public hearing regarding the preliminary plat for Case SD -4-01 and unanimously recommended approval of Case SD -4-01 by a vote of 6 to 0 (with 1 vacancy):and WHEREAS,the Mayor and City Council finds this preliminary plat proposed in Case SD -4-01 to be consistent with the Medium Density Residential Designation at one (1)to six (6)dwelling units per acre, of the 1999 Apache Junction General Plan and amendments thereto:and WHEREAS,this City Council finds this preliminary subdivision plat to be in compliance with the Apache Junction City Code,Volume II, Land Development Code,Chapter 1,Zoning Ordinance and Chapter 2, Subdivision Regulations,and Ordinance No.1152,which authorized the CR-3 zoning for the property:and WHEREAS,the Mayor and City Council finds that the stipulations required for this subdivision are necessary for sound and orderly RESOLUTION NO.01-11 PAGE 1 OF 3 community development,for preservation of community values and for the promotion of the general health,safety,convenience,and welfare of the citizens of Apache Junction. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona.that: The preliminary subdivision plat for Sonoran Wells,be approved with the following conditions: 1)The property owners shall install any necessary on -site and off- site improvements,as determined by the City Engineer,including, but not necessarily limited to,paving,gutters,curbs, sidewalks,streetlights,fire hydrants,utilities and on -site retention or detention basins. 2)The property owners shall relocate the two proposed fire hydrants and place two additional hydrants in the locations provided by the Fire Marshall per his preliminary plat review. 3)All open spaces shall be maintained by a Homeowners Association. 4)The retention basins are to be designed with curvilinear shapes and all usable open spaces are to be located above the 10 year and 24 hour storm level. 5)A meandering pedestrian trail shall be located along the edge of the drainage channel with accompanying landscaping.
