HomeMy WebLinkAboutRES 02-17RESOLUTION NO. 02-17 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE FINAL SUBDIVISION PLAT FOR MERIDIAN MANOR SUBDIVISION, PHASE III, CASE SD -1-02, BY CLYDE BARNEY ON BEHALF OF RSC ENTERPRISES, L.L.C. WHEREAS, the owner/developer in case SD -1-02 proposes to amend the previously approved final plat of Meridian Manor Subdivision, originally approved under case number SD -3-96, to redesignate the use of nine lots, to allow conventional homes and non -age restricted ownership in Phase III of Meridian Manor; and, WHEREAS, the owner/developer proposes to provide a wall to separate Phase Ill from Phases I & II without obstructing or blocking streets or drainage, to provide additional open space and amenities by designating eight previously platted lots into recreation/useable area, to delete one further lot in order to create added access off Delaware Drive, to amend the current Covenants, Conditions and Restrictions to clarify what amenities the residents of each phase will be permitted to use, and to have inhabitants of Phase III continue to bear their portion of maintenance costs for streets and retention areas; and WHEREAS, the City of Apache Junction Planning and Zoning Commission held a public hearing regarding the original final plat for Meridian Manor Subdivision, case number SD -3-96,on June 25, 1996 and recommended approval of the plat to the City Council; and, WHEREAS, the Mayor and City Council of the City of Apache Junction held a public hearing regarding the final plat for Meridian Manor Subdivision, case number SD -3-96, on September 3, 1996 and approved the plat by a vote of 7 to 0; and, WHEREAS, this Council finds this proposed final plat amendment to be in compliance with the TH/PD (Trailer Homesites by Planned Development) zoning on the property, and the Apache Junction City Code,Volume II, Land Development Code,Chapter 1,Zoning Ordinance,and the Apache Junction City Code,Volume II,Land Development Code,Chapter 2,Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction, Arizona, that: RESOLUTION NO. 02-17 PAGE ONE OF THREE 1) A wall shall be constructed along the southern property lines of Lots 127, 176, 193, 196, 213, 216, 233,279-289 and 169, to separate Phase III from the other phases. The wall shall not block or obstruct any streets, to allow for proper traffic circulation as well as necessary water channeling. 2) A new drive entrance shall be installed off of South Delaware Drive to replace former Lot 166. The entrance shall include monument facades. One of the facades may contain signage announcing the subdivision. Landscaping along this entrance shall be designed so as to provide for required visibility. No plant materials exceeding two feet in height, or pruned to a height less than 4' from grade shall be installed. 3)Former Lots 181, 182, 187 & 188 shall be redesignated as useable open space and known in the future as Tract "R".Former lots 259, 260, 275 & 276 shall be redesignated as useable open space and known in the future as Tract "N". Recreational amenities, no less than 53 play station points in value (as defined in the Parks and Recreation Guidelines for HOA maintained areas) shall be installed and maintained in Phase III of Meridian Manor. 4) The existing Covenants, Conditions and Restrictions for Meridian Manor Homeowners Association shall be amended to clarify what amenities the residents of each phase shall be permitted to use and to specify that the residents of Phase III (through their HOA fees) shall continue to bear their portion of the maintenance costs of the streets and the retention areas located in Phases I & II.
