HomeMy WebLinkAboutRES 02-05RESOLUTION NO. 02-05 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE/CITY OF APACHE JUNCTION, ARIZONA, AUTHORIZING THE CRE,MON OF A TWENTY-EIGHT FOOT (28') WIDE PRIVATE ACCESS/WAY PURSUANT TO THE APACHE JUNCTION CITY CODE,VfOLUME II, LAND DEVELOPMENT CODE,CHAPTER 1,ZONING ORDINANCE, ARTICLE 20 PARKING, LOADING, AND INTERIOR OR/PRIVATE STREET STANDARDS,SECTION 20.0108 PRIVATE/ACCESS WAY STANDARDS,IN CASE PA -1-02, FOR THE PURP9BE OF PROVIDING LEGAL ACCESS TO CERTAIN PROPOSED TH (TRAILER HOMESITES)-ZONED PARCELS DESCRIBED ,HEREIN. WHEREAS, a perpetual Private Access Way, descfi6ed as follows: The West 28 feet of the North 358 feet of the fq)rowing described parcel: That part of the North half of the Southwest cluarter of Section 30, Township 1 North, Range 8 East of the Gila and Salt River B91e and Meridian, Pinal County, Arizona, described as follows: \ /Beginning 990 feet East of the North est corner of the said Southwest quarter of Section 30, Township 1 North, Ran 8 East of the Gila and Salt River Base and Meridian, Pinal County, Arizona, a the TRUE POINT OF BEGINNING; THENCE South 660 feet; THENCE East 330 fee THENCE North 660 feet; THENCE West 330 feet to the TRUE POINT OF BEGINN G; has been requested in CaselPA-1-02; and WHEREAS, said Private/Access Way is for the benefit of providing perpetual right of ingress and egress anOtilities for the proposed parcels described as follows: PARCEL "1":The West 130 feet of the North 330 feet of the following described parcel: /3That part of the 4 orth half of the Southwest quarter of Section 30, Township 1 North, Range 8 East the Gila and Salt River Base and Meridian, Pinal County, Arizona, described as follows: Beginning 90 feet East of the Northwest corner of the said Southwest quarter of Section O, Township 1 North, Range 8 East of the Gila and Salt River Base and Meridi , Pinal County, Arizona, as the TRUE POINT OF BEGINNING; THENCE South 660 f t; THENCE East 330 feet; THENCE North 660 feet; THENCE West 330 feet to the )4UE POINT OF BEGINNING; and RESOLUTION NO. 02-05 Page 1 of 3 PARCEL "2":The South 330 feet of the following described parcel: That part of the North half of the Southwest quarter of Section 30, Township 1 North, Range 8 East of the Gila and Salt River Base and Meridian, Pinal County, Arizona, described as follows: Beginning 990 feet East of the Northwest corner of the said Southwest quarter of Section 30, Township 1 North, Range 8 East of the Gila and Salt River Base and Meridian, Pinal County, Arizona, as the TRUE POINT OF BEGINNING; THENCE South 660 feet; THENCE East 330 feet; THENCE North 660 feet; THENCE West 330 feet to the TRUE POINT OF BEGINNING; and WHEREAS, the creation of the Private Access Way is necessary to provide legal access to the above described parcels; and WHEREAS, on February 26, 2002, the City of Apache Junction Planning and Zoning Commission, after holding a public hearing, did recommend denial of the Private Access Way; and WHEREAS, satisfactory evidence has been received to indicate that the requested Private Access Way does not present a potential hazard to vehicular and/or pedestrian traffic; and WHEREAS, the requested Private Access Way would not be detrimental to the public health, safety and welfare. NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction, Arizona, that the Private Access Way, as described above, be approved subject to the following conditions: 1.The property owner shall construct a 28 -foot -wide by 358 -foot long (as measured from the centerline of the W. 16th Avenue mid -section line alignment) Private Access Way for perpetual ingress, egress, and utility purposes for the proposed future land split presented in Case PA -1-02. The easement shall consist of pavement (2 inches over native grade), 24 feet wide, with 2 -foot -wide shoulders on each side for underground utilities.The curbing, gutter, sidewalk and streetlight improvement requirements of Section 20.0108 shall be waived. 2.The property owner shall coordinate with Planning Staff to create proper legal documents to be recorded for the Private Access Way. 3.The property owner shall dedicate to the City the North 40 feet of the property for public roadway and utility purposes, along with any necessary cut-off corners as determined by the City Engineer. RESOLUTION NO. 02-05 Page 2 of 3 4.The property owner shall contact and coordinate with the City Epgineer prior to construction of the Private Access Way and to receive an erfcroachment permit to connect the Private Access Way to W. le Aveny PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCI OF THE CITY OF APACHE JUNCTION, ARIZONA, THIS DAY OF , 2002.
