A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AUTHORIZING THE ACQUISITION OF A FRONTAGE PORTION
OF CERTAIN PROPERTY LOCATED AT 543 NORTH IRONWOOD DRIVE,APACHE
JUNCTION,ARIZONA,BY EXERCISE OF THE POWER OF EMINENT DOMAIN AS
NECESSARY AND REQUIRED FOR COMPLETION OF THE IRONWOOD DRIVE ROAD
IMPROVEMENT PROJECT:AND DECLARING AN EMERGENCY.
WHEREAS,it is necessary for the City of Apache Junction to acquire,for
the public purpose of the Ironwood Drive Road Improvement Project,including the
expansion of Ironwood Drive and related facilities,an approximately 17'x 72.6'
frontage portion of certain property located at 543 North Ironwood Drive,Apache
Junction,Arizona (as such exact description may be modified from time to time as
may be necessary to carry out the purposes of this Resolution)and hereinafter
referred to as the "Needed Property";and
WHEREAS,acquisition of the Needed Property for such purpose by exercise of
the power of eminent domain is authorized under A.R.S.§ 12-1111.
NOW,THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of
Apache Junction,Arizona as follows:
SECTION I AUTHORITY TO EXERCISE EMINENT DOMAIN
The City of Apache Junction staff and attorneys are authorized and directed to
bring a judicial action under the power of eminent domain to acquire the Needed
Property immediately,including seeking an order of immediate possession,and to
take such other action as necessary to prosecute said action and to acquire the
Needed Property for its market value,as determined by a qualified appraiser.
SECTION I I DECLARING AN EMERGENCY
It is necessary for the preservation of peace,health and safety of the City of
Apache Junction, Arizona,that this resolution become effective immediately.Any
delay in the road improvement may present a serious traffic safety hazard
subjecting the City's residents to traffic injuries and property damage,and may
cause the City serious litigation exposure.An emergency is hereby declared to
exist and this resolution .shall be effective immediately upon passage and
adoption by at least three-quarters of the Members of City Council.
