A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,RE -APPROVING AN EXPIRED PRELIMINARY
SUBDIVISION PLAT,CASE NO.SD -6-98,COYOTE RUN,BY HERSHEL E.
WILSON.
WHEREAS,on May 4,1999,the City Council approved Resolution No.99-
17,which approved the preliminary subdivision plat for Coyote Run
Subdivision,Case SD -6-98:and
WHEREAS.pursuant to the Apache Junction City Code.Volume II.Land
Development Code,Chapter 2.Subdivision Regulations Section 2.04.7(b).the
preliminary plat expired prior to the submittal of the final plat
application:and
WHEREAS,the City Council finds that the preliminary plat for Coyote
Run Subdivision,as conceptually approved by Ordinance No.1059,Case P7-18-
98,and with the same conditions as set forth in Resolution No.99-17.must
be re -adopted prior to considering the final plat for approval:and
WHEREAS,the subdivider in Case SD -6-98 proposes to subdivide five
acres in the Northwest Quarter of Section 28.Township One North.Range Eight
East,Gila and Salt River Base and Meridian,Pinal County.Arizona,into 14
residential lots pursuant to Arizona Revised Statutes Annotated ("A.R.S.-)
§ 9-463 et seq.,and pursuant to the Apache Junction Subdivision Regulations
set forth in the Apache Junction City Code (-A.J.C.C.-).Volume II.Land
Development Code,Chapter 2:and
WHEREAS.the Apache Junction Planning and Zoning Commission held a
public hearing regarding SD -6-98 on February 23,1999 and recommended
approval of the preliminary plat by a vote of 6 to 0:and
WHEREAS.the Mayor and City Council finds this proposed preliminary
plat to be in compliance with the Apache Junction City Code,Volume II.Land
Development Code,Chapter 1,Zoning Ordinance pursuant to Ordinance Number
1059 (companion Case P7-18-98)which amended the Zoning District Map,City of
Apache Junction,Arizona.and changed the zoning district classification from
CR-1 (Single Family Residence Zone,residences on 20.000 -net square foot
minimum lots)to CR-2 (Single Family Residence Zone,residences on 11,000 -net
square foot minimum lots in approved subdivisions):and

WHEREAS,the Mayor and City Council finds this proposed preliminary
plat to not be in conflict with the Medium Density ("MD")designation of the
Apache Junction General Plan:and
WHEREAS.the Mayor and City Council finds this proposed preliminary
plat to be in compliance with the Apache Junction City Code,Volume II.Land
Development Code,Chapter 1,Zoning Ordinance:and
WHEREAS,the Mayor and City Council finds that the stipulations
required for this subdivision are necessary for sound and orderly community
development,for preservation of community values and for the promotion of
the general health,safety,convenience,and welfare of the citizens of
Apache Junction.
NOW.THEREFORE.BE IT RESOLVED by the Mayor and City Council of the
City of Apache Junction.Arizona.that:
Said preliminary subdivision plat,SD -6-98.Coyote Run.be
conditionally approved subject to the following conditions:
1)All outstanding conditions of Ordinance No.1059.approving the
rezoning from CR-1 to CR-2.that are still in effect shall apply.
2)The subdivision shall be developed in compliance with all
applicable codes and regulations,including,but not limited
to,installation of the two fire hydrants as recommended by
the Apache Junction Fire District,in a letter dated December
21,1998.a copy which is on file with the Planning Division
of the Apache Junction Development Services Department in
Case File No.SD -6-98.
3)All retention basins and drainage easements shall be combined
as part of the adjacent residential lots,which include lot
numbers 8.9.12,13,and 14.Such areas shall be maintained
by the property owners to City standards.with such restriction
set forth on the deeds to each lot.The Final Plat shall also
reflect that the retention basins and drainage easements shall
be maintained by the property owners of each lot.
PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION.ARIZONA,THIS 21ST DAY OF MAY 2002.
