A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,CERTIFYING THE 2002-2003 FISCAL YEAR
MUNICIPAL COURT QUARTERLY REVENUE COLLECTIONS:DIRECTING
STAFF TO FORWARD THE CERTIFICATION TO THE STATE TREASURER'S
OFFICE;AND DIRECTING STAFF TO SEND SEVENTY-FIVE PERCENT OF
ANY QUARTERLY REVENUES COLLECTED IN EXCESS OF THE CERTIFIED
BASELINE LEVELS TO THE STATE TREASURER'S OFFICE.
WHEREAS,the Arizona State legislature recently enacted Arizona Revised
Statutes Annotated §12-116.04.which enables the State to collect
additional monies from cities and towns to balance the State's budget
deficit for rising health insurance costs and retirement benefits for
state employees;and
WHEREAS,to balance the State budget shortfall,the State requires
cities and towns to,on or before September 1,2003,certify their 2002-
2003 Fiscal Year quarterly revenue collections and forward such
certification to the State Treasurer's Office;and
WHEREAS,these certified figures will be used as the baseline court
collection levels;and
WHEREAS,the new law also requires cities and towns,on a quarterly
basis,to certify the amounts collected above the baseline levels within
fifteen (15)days after the end of each quarter;and
WHEREAS,that if collections exceed the baseline levels,cities and
towns must transmit seventy-five percent (75%)of the funds collected
over the baseline levels to the State Treasurer's Office within fifteen
(15)days after the end of each quarter;and
WHEREAS,the law requires the certification figures include collections
for court fees,diversions,adult and juvenile probation administration,
monetary assessments,fines,penalties,surcharges,sanctions and
forfeitures;excluded amounts from the certification figures shall be
clean election and child support fees,restitution and exonerated bonds.
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,as follows:
SECTION I :The Mayor and City Council certify the 2002-2003 Fiscal Year
municipal court quarterly revenue collections as reflected in the
RESOLUTION NO.03-20
PAGE 1 OF 2
attached Exhibit A.The City Clerk shall send a copy of this Resolution
including Exhibit A to the Arizona State Treasurer's Office before
September 1,2003.
SECTION II:Municipal court staff is directed to compare the baseline
certification figures set forth in Exhibit A to upcoming quarterly
collections which shall be certified by the Mayor and City Council each
quarter.I f the collected quarterly amounts exceed the baseline levels
set forth in Exhibit A,the City Finance Department shall transmit
seventy-five percent (75%)of any amount above the baseline level for
each quarter to the Arizona State Treasurer's Office within fifteen (15)
days after the end of each quarter.
