A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,APPROVING THE FINAL SUBDIVISION
PLAT FOR SANTA FE SQUARE,CASE SD -3-02,BY NIEL F.NIELSON.
WHEREAS,the subdivider in case SD -3-02 proposes to subdivide
2.33 gross acres legally described as the East 350 feet of the North
half of the Northwest quarter of the Northwest quarter of the Southwest
quarter of Section 28,Township 1 North,Range 8 East of Gila and Salt
River Base and Meridian,Apache Junction,Pinal County,Arizona,into
10 residential lots pursuant to Arizona Revised Statutes (A.R.S.),
Title 9,Chapter 4,Article 6.2,and pursuant to the Apache Junction
City Code,Volume II,Land Development Code,Chapter 1,Zoning
Ordinance,Section 15.0400.CR-3 Single Family Residence Zone,and
Chapter 2,Subdivision Regulations;and
WHEREAS,on September 17,2002,the Mayor and City Council
approved Ordinance No.1166 which rezoned the subject property from GR
(General Rural)zone to CR-3 (Single Family Residence)zone by a vote
of 7-0:and
WHEREAS.on February 25,2003,the Planning and Zoning Commission
held a public hearing regarding the preliminary plat for SD -3-02 and
recommended approval of SD -3-02 by a vote of 6-1:and
WHEREAS.on April 1,2003,the Mayor and City Council approved
Resolution No.03-03 approving the preliminary plat for Case SD -3-02 by
a vote of 7-0;and
WHEREAS,the Mayor and City Council finds this final subdivision
plat proposed in Case SD -3-02 to be consistent with the Medium Density
Residential designation at one to six dwelling units per acre,of the
1999 Apache Junction General Plan and amendments thereto;and
WHEREAS,the Mayor and City Council finds this final subdivision
plat to be in compliance with the Apache Junction City Code,Volume II,
Land Development Code,Chapter 1,Zoning Ordinance and Chapter 2,

Subdivision Regulations.Ordinance No.1166,which authorized the CR-3
zoning for the property,and Resolution No.03-03,which approved the
preliminary plat for Case SD -3-03.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the
City of Apache Junction,Arizona,that:
1)The final subdivision plat for Santa -Fe Square,Case SD -3-02 is
hereby approved.
2)Staff is directed pursuant to A.R.S.§9-463.01(J)to record the
final plat with the Pinal County Recorder and to collect the final
plat recording fee from the subdivider and remit such amount to the
Pinal County Recorder.
