A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,APPROVING THE PRELIMINARY SUB-
DIVISION PLAT FOR SANTA -FE SQUARE,CASE SD -3-02,BY NIEL F.
NIELSON.
WHEREAS,the sub -divider in Case SD -3-02 proposes to subdivide
2.33 gross acres,legally described as the East 350 feet of the North
half of the Northwest quarter of the Northwest quarter of the Southwest
quarter of Section 28,Township 1 North,Range 8 East of Gila and Salt
River Base and Meridian,Apache Junction,Pinal County,Arizona,into
ten (10)residential lots,pursuant to Arizona Revised Statutes
(A.R.S.),Title 9.Chapter 4,Article 6.2,and pursuant to the Apache
Junction City Code,Volume II,Land Development Code,Chapter 1,
Zoning Ordinance,Section 15.0400,CR-3 Single Family Residence Zone,
and Chapter 2,Subdivision Regulations:and
WHEREAS,on September 17,2002,the Mayor and City Council
approved Ordinance No.1166 which rezoned the subject property from GR
(General Rural Zone)to CR-3 (Single Family Residence Zone)by a vote
of 7 to 0:and
WHEREAS,on February 25,2003,the Planning and Zoning Commission
held a public hearing regarding the preliminary plat for Case SD -3-02
and recommended approval of Case SD -3-02 by a vote of 6 to 1:and
WHEREAS,the Mayor and City Council finds this preliminary plat
proposed in Case SD -3-02 to be consistent with the Medium Density
Residential designation at one (1)to six (6)dwelling units per acre,
of the 1999 Apache Junction General Plan and amendments thereto:and
WHEREAS,this City Council finds this preliminary subdivision plat
to be in compliance with the Apache Junction City Code,Volume II,Land
Development Code,Chapter 1,Zoning Ordinance and Chapter 2,
Subdivision Regulations,and Ordinance No.1166,which authorized the
CR-3 zoning for the property.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of
the City of Apache Junction,Arizona,that:

The preliminary subdivision plat for Santa -Fe Square be approved with
the following conditions:
1)All stipulations of Ordinance No.1166 are in 'r411 force and
effect and shall govern the design of the final subdivision plat
and construction of improvements.
2)Within one year of preliminary plat approval,the applicants
shall submit for formal review a final subdivision plat for the
proposed development.
3)The creation of Key Lots as defined in Article 5 (Definitions)of
the Zoning Ordinance shall be prohibited.
