HomeMy WebLinkAboutRES 04-16'RESOLUTION NO.04-16 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE "JUNCTION,ARIZONA,APPROVING A PRELIMINARY PLAT FOR CASA VILLA,A RESIDENTIAL SUBDIVISION,IN CASE SD -2-04,BY RICH LEWANDOWSKI,ON BEHALF OF HOMES DIRECT/HOUSEMART AND RANDY QUESENBERRY. WHEREAS,the sub -divider in case SD -2-04 proposes to subdivide ten (10)gross acres,legally described as the East half of the Northeast quarter of the Northwest quarter and the West half of the Northwest quarter of the Northeast quarter.both of the Southwest quarter of Section 30,Township 1 North,Range 8 East of the Gila and Salt,River Base and Meridian,Pinal County.Arizona,into 31 residential lots pursuant to Arizona Revised Statutes (A.R.S.)Title 9, Chapter 4,Article 6.2,and pursuant to the Apache Junction City Code, Volume II Land Development Code,Chapter 1,and Chapter 2,Subdivision Regulations.Zoning Ordinance,Section 15.0400,CR-3 Single Family Residence Zone,Section 19.0101 Planned Development ZOning .District: and WHEREAS,on'June 22,2004.the Planning and Zdn'ihg._COm01;ssion held a public hearing regarding the preliminary plat for -S64-04 and recommended approval of SD -2-04 by a unanimouSNote:,and WHEREAS the City Council finds this preliminary subdivision plat to be in compliance with the Apache Junction City Code,Volume II,Land Development Code,Chapter 1,and Chapter 2,Subdivision Regulations. Zoning Ordinance,Section 15.0400,CR-3 Single Family Residence Zone, Section 19.0101,Planned Development Zoning District.and Ordinance No. 1201 which authorized the preliminary plat for the property. NOW.THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona.that: The preliminary subdivision plat for Casa Villa be approved,subject to the following stipulations: RESOLUTION NO.04-16 Page 1 of 2 1)All HVAC units shall be ground mounted in the rear or sides of the homes and shall not encroach within five feet (5')of property lines. 2)Within one year of Preliminary Plat approval,the applicant shall submit,•for final review,a Final Subdivision Plat for the proposed development. 3)All aspects of Ordinance No.1201 shall apply to the Final Plat design as well as all development of the parcels.
