A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,APPROVING THE FINAL SUBDIVISION
PLAT FOR SIERRA ENTRADA GARDEN HOMES UNIT IV,CASE SD -5-03,
BY BRENT PAUSTIAW ON BEHALF OF MELVIN MARTIN.
WHEREAS,the sub -divider in Case SD -5-03 proposes to subdivide
3.17 gross acres,legally described as Tract "C",Sierra Entrada Garden
Homes,Unit Two,according to the plat of record in the office of the
Pinal County Recorder,Book 19,Page 38,into 15 residential lots,
pursuant to Arizona Revised Statutes ("A.R.S.").Title 9,Chapter 4.
Article 6.2,and pursuant to the Apache Junction City Code,Volume II,
Land Development Code,Chapter 1,Zoning Ordinance,Article 19,Planned
Development Zoning District,and Chapter 2.Subdivision Regulations:
and
WHEREAS.on October 21.2003.the Mayor and City Council approved
Ordinance No.1188.which amended the plan of development originally
approved under Ordinance No.145,to re -designate Tract "C"of the
Sierra Entrada Garden homes Unit II,from a septic pond area to fifteen
(15)new residential lots,by a vote of 6 to 0 (Vice -Mayor Eck absent):
and
WHEREAS,on February 24,2004,the Planning and Zoning Commission
held a public hearing regarding the preliminary plat for Case SD -5-03
and unanimously recommended approval of SD -5-03 by a vote of 7 to 0:
and
WHEREAS.on April 6.2004.the Mayor and City Council approved
Resolution No.04-04 approving the preliminary plat for Case SD -5-03 by
a vote of 7 to 0:and
WHEREAS,the Mayor and City Council finds this final plat
proposed in Case SD -5-03 to be consistent with the Medium Density
Residential Designation at one to six dwelling units per acre of the
1999 Apache Junction General Plan and amendments thereto:and

WHEREAS,the City Council finds this preliminary subdivision:'
plat to be in compliance with the Apache Junction City Code,'Volume II,
Land Development Code,Chapter 1,Zoning Ordinance and Chapter 2,
Subdivision Regulations,and Ordinance No.1188,which authorized the
amended plan of development for the property,and Resolution No.04-04,
which approved the preliminary plat for the development.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of
the City of Apache Junction,Arizona,that:
1.The final subdivision plat for Sierra Entrada Garden
Homes Unit IV,Case SD -5-03,is approved.
2.Staff is directed,pursuant to Arizona Revised Statutes
9-463.01(J),to record the final plat with the Pinal
County Recorder and collect the final plat recording
fee from the sub -divider and remit such amount to the
Pinal County Recorder.
