Arizona includes *an r niz area located within six miles of the City of Apache Junction 1pora e limits: and WHERE t it of Apache Junction has received a request from certain citi, e of ld Canyon to approve the incorporation of the City of Gol yo . NOW, T R ORE, BE IT RESOLVED by the Mayor and City Council of the City of A the Junction, Arizona, that: SECTION I : That the proposed incorporation of the City of Gold Canyon, pursuant o Arizona Revised Statutes Section 9-101.01(B)(1) is approved subject o the conditions set forth herein. 1. That approval is granted only for the areas depicted in the map attached hereto as "Exhibit A" and entitled "proposed City of Gold Canyon boundaries" : the approval is further conditioned upon a Metes and Bounds Legal Description being equal to or less than the area depicted on Exhibit "A" ; and RESOLUTION NO. 05-03 PAGE 1 OF 2 2. That should the incorporators seek an election, this resolution is in effect for only the immediate ensuing incorporation election and any subsequent election for incorporation of any portion of the area depicted in "Exhibit A" shall require a new resolution of the C' y Council . SECTION II Repealing Any Conflicting Provisions: That all esolutions and parts of resolutions in conflict with this resoluti are hereby repealed. SECTION III Providing for Severabilit-y: ' i ny se ion, subsection, sentence, phrase, clause or portion of h's ordi ance is for any reason held to be .invalid or unconstitution he ecision of any court of competent jurisdiction , such decisi.O� all t affect the validity of the remaining portions thereof.
