HomeMy WebLinkAboutRES 05-07RESOLUTION NO.05-07 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,APPROVING THE FINAL SUBDIVISION PLAT FOR IDAHO CREEK VILLAS,PHASES TWO AND THREE,CASE SD -4-02,BY APACHE JUNCTION TOWN SQUARE,L.L.C.. WHEREAS,the subdivider in Case SD -4-02 proposes to subdivide two parcels,a combined 19.68 grosS acres in the East half of the Southeast quarter of Section 17,Township 1 North ,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona,into 244 residential condominiums lots pursuant to Arizona Revised Statutes ("A.R.S."),Title 9,Chapter 4,Article 6.2,and pursuant to the Apache Junction City Code,Volume II,Land Development Code,Chapter 1, Zoning Ordinance,Article 19,Planned Development Zoning District,and Chapter 2,Subdivision Regulations;and WHEREAS,on August 6,2002,the Mayor and City Council of the City of Apache Junction approved Ordinance No.1155 which amended the Planned Development concept plan originally approved under Ordinance No.456 for the property by a vote of 6 to 1;and WHEREAS,on February 25,2003,the Planning and Zoning Commission held a public hearing regarding the preliminary plat for Case SD -4-02, formerly called Quail Creek Villas,Phases Two and Three,and recommended approval by a vote of 7 to 0;and WHEREAS,on April 1,2003,the Mayor and City Council of the City of Apache Junction approved Resolution No.03-08 approving the Preliminary Plat for Case SD -4-02 by a vote of 7 to 0;and WHEREAS on May 2,2006,the Mayor and City Council re -approved the preliminary plat previously approved by Resolution No.03-08 because i t had expired;said re -approval pursuant to Resolution No.06- 14;and WHEREAS,this City Council finds this final subdivision plat to be in substantial compliance with the Apache Junction City Code,Volume II,Land Development Code,Chapter 1,Zoning Ordinance and Chapter 2, Subdivision Regulations,and Ordinance No.1155,which authorized the preliminary plan for the property. RESOLUTION NO.05-07 PAGE 1 OF 3 NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that the final subdivision plat for Idaho Creek Villas,Phases Two and Three,be approved subject to the following conditions: 1)The final subdivision plat shall not be recorded until all of the items below have been satisfied,provided or complied with. 2)The subdivider shall provide the Planning Division with a certificate of 100 -year assured water supply,issued by the Arizona Department of Water Resources,reflecting Apache Junction Town Square,L.L.C.,as the property owners. 3)The property owners shall provide to the Development Services Engineer a performance bond for off -site improvements of no less than $542,278.00 for Phase Two and $225,029.00 for Phase Three. 4)All other conditions and requirements of Ordinance No.1155 and Resolution No.06-14 are still in full force and effect. 5)Staff is directed,pursuant to Arizona Revised Statutes Section 9-463.01(J),to record the final plat with the Pinal County Recorder and collect the final plat recording fee from the subdivider and remit such amount to the Pinal County Recorder.
