A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,APPROVING THE FINAL SUBDIVISION
PLAT FOR CRESCENT MOON CONDOMINIUMS,CASE SD -3-04,BY AZIZ
HELAL.
WHEREAS,the sub -divider in case SD -3-04 proposes to re -sub-
divide four lots of the Palm Springs Unit Five,legally described as
Lots 65,66,67,and 68,into 16 condominium dwellings pursuant to
Arizona Revised Statutes ("A.R.S."),Title 9,Chapter 4,Article 6.2,
and pursuant to the Apache Junction City Code,Volume II,Land
Development Code,Chapter 1,and Chapter 2,Subdivision Regulations,
and Zoning Ordinance,Section 16.0100,CB -1 Local Business Zone,and
Section 19.0101 Planned Development Zoning District;and
WHEREAS,on March 1,2005,the Mayor and City Council approved
Ordinance No.1227 which rezoned the subject property from CB -1 (Local
Business Zone)to CB-1/PD (Local Business Zone by Planned Development);
and
WHEREAS,the Mayor and City Council finds that the proposed re-
subdivision is less than five (5)acres in size and,pursuant to Apache
Junction City Code,Volume II,Land Development Code,Chapter 2,
Subdivision Regulations,Section 6.06.2,exempts the subdivider from
all of the preliminary plat requirements;and
WHEREAS,the Mayor and City Council finds this final plat
proposed in Case SD -3-04 to be consistent with the 1999 Apache Junction
General Plan and amendments thereto;and
WHEREAS,this City Council finds this final subdivision plat to
be in compliance with the Apache Junction City Code,Volume II,Land
Development Code,Chapter 1,Zoning Ordinance and Chapter 2,
Subdivision Regulations.

NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of
the City of Apache Junction,Arizona,that:
1)The final subdivision plat for Crescent Mood
Condominiums,Case SD -3-04,is approved.
2)Staff is directed,pursuant to A.R.S.9-463.01(J),
to record the final plat with the Pinal County Recorder
and collect the final plat recording fee from the sub-
divider and remit such amount to the Pinal County
Recorder.
