HomeMy WebLinkAboutRES 06-37RESOLUTION NO. 06-37 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,DECLARING AS A PUBLIC RECORD THAT CERTAIN DOCUMENT FILED WITH THE CITY CLERK AND ENTITLED "APACHE JUNCTION CITY CODE,CHAPTER 7 BUILDING,"AND DECLARING AS A PUBLIC RECORD THAT CERTAIN PUBLISHED COMPILATION OF RULES OR REGULATIONS PREPARED BY TECHNICAL TRADE ASSOCIATIONS FILED WITH THE CITY CLERK AND ENTITLED:"UNIFORM ADMINISTRATIVE CODE"(1997 EDITION),"INTERNATIONAL BUILDING CODE" (2006 EDITION),"INTERNATIONAL MECHANICAL CODE"(2006 EDITION),"INTERNATIONAL FIRE CODE"(2006 EDITION), "INTERNATIONAL RESIDENTIAL CODE"(2006 EDITION), "NATIONAL ELECTRIC CODE"(2005 EDITION),"UNIFORM PLUMBING CODE"(1994 EDITION),"UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS"(1997 EDITION), "UNIFORM SIGN CODE"(1997 EDITION),"ARIZONANS WITH DISABILITIES ACT"AND ITS IMPLEMENTATION RULES,AND "AMERICANS WITH DISABILITIES ACT ACCESSIBILITY GUIDELINES FOR BUILDINGS AND FACILITIES";AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS,Arizona Revised Statutes Annotated (hereinafter "A.R.S.") § 9-802 permits municipalities to enact the provisions of a code or public record in existence without setting forth such provisions in full text as long as the adopting ordinance is published in full text and at least three copies of the code or public record are filed in the office of the clerk of the municipality and are made available for public use and inspection; and WHEREAS,pursuant to A.R.S.§§9-801(1)and 9-802,such codes include health,safety and welfare rules or regulations; and WHEREAS,City staff has identified numerous such codes herein,and it is the intent of the City to declare such documents and compilations as public records,on file in the office of the City Clerk. RESOLUTION NO. 06-37 PAGE 1 OF 4 NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA AS FOLLOWS: SECTION I IN GENERAL 1.That certain document entitled "Apache Junction City Code, Chapter 7 Building,"three copies of which are on file in the office of the City Clerk of the City of Apache Junction,Arizona,is hereby declared to be a public record,shall be made available for public use and inspection, and shall remain on file with the City Clerk. 2.That certain publication entitled "Uniform Administrative Code"(1997 Edition),as published by the International Conference of Building Officials, three copies of which are on file in the office of the City Clerk of the City of Apache Junction, Arizona, is hereby declared to be a public record,shall be made available for public use and inspection, and shall remain on file with the City Clerk. 3.That certain publication entitled "International Building Code"(2006 Edition),as published by the International Conference of Building Officials, three copies of which are on file in the office of the City Clerk of the City of Apache Junction, Arizona, is hereby declared to be a public record,shall be made available for public use and inspection, and shall remain on file with the City Clerk. 4.That certain publication entitled "International Fire Code" (1997 Edition),as published by the International Code Council,Inc.three copies of which are on file in the office of the City Clerk of the City of Apache Junction, Arizona, is hereby declared to be a public record, shall be made available for public use and inspection,and shall remain on file with the City Clerk. 5.That certain publication entitled "International Residential Code"(2006 Edition),as published by the International Code Council,Inc. three copies of which are on file in the office of the City Clerk of the City of Apache Junction, Arizona, is hereby declared to be a public record,shall be made available for public use and inspection, and shall remain on file with the City Clerk. RESOLUTION NO. 06-37 PAGE 2 OF 4 6.That certain publication entitled "National Electrical Code"(2005 Edition),published by the National Fire Protection Agency,as published by the International Conference of Building Officials, three copies of which are on file in the office of the City Clerk of the City of Apache Junction, Arizona, is hereby declared to be a public record,shall be made available for public use and inspection, and shall remain on file with the City Clerk. 7.That certain publication entitled "Uniform Plumbing Code" (1994 Edition),as published by the International Association of Plumbing and Mechanical Officials,three copies of which are on file in the office of the City Clerk of the City of Apache Junction, Arizona, is hereby declared to be a public record,shall be made available for public use and inspection, and shall remain on file with the City Clerk. 8.That certain publication entitled "Uniform Code for the Abatement of Dangerous Buildings"(1997 Edition),as published by the International Conference of Building Officials, three copies of which are on file in the office of the City Clerk of the City of Apache Junction, Arizona, is hereby declared to be a public record,shall be made available for public use and inspection,and shall remain on file with the City Clerk. 9.That certain publication entitled "Uniform Sign Code" (1997 Edition),as published by the International Conference of Building Officials,three copies of which are on file in the office of the City Clerk of the City of Apache Junction,Arizona,is hereby declared to be a public record,shall be made available for public use and inspection, and shall remain on file with the City Clerk. 10.That certain publication entitled "International Mechanical Code"(2006 Edition),as published by the International Code Conference Council, Inc., three copies of which are on file in the office of the ‘City Clerk of the City of Apache Junction,Arizona,is hereby declared to be a public record,shall be made available for public use and inspection, and shall remain on file with the City Clerk. RESOLUTION NO. 06-37 PAGE 3 OF 4 11.That certain documents entitled "Arizonans With Disabilities Act,"arid its Implementing Rules,and "Americans With Disabilities Act Accessibility Guidelines for Buildings and Facilities," three copies of which are on file in the office of the City Clerk of the City of Apache Junction,Arizona,are hereby declared to be a public record,shall be made available for public use and inspection, and shall remain on file with the City Clerk. SECTION II ESTABLISHING AN EFFECTIVE DATE This resolution shall take effect on November 1, 2006.
