A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION, ARIZONA, APPROVING A FINAL
SUBDIVISION PLAT FOR THE "VISTA MEADOWS" SUBDIVISION,
IN CASE SD -5-05, BY DOWN TO EARTH PROPERTIES, LLC,
REPRESENTED BY DURAN THOMPSON.
WHEREAS, the subdivider in Case SD -5-05 proposes to
subdivide Pinal County Assessor Parcel Number 103-20-015,
approximately 5 gross acres, into 16 residential lots for
conventional single-family homes, pursuant to Arizona
Revised Statutes ("A.R.S.") Title 9, Chapter 4, Article
6.2, and pursuant to the Apache Junction City Code,Volume
II,Land Development Code,Chapter 1,Zoning Ordinance,
Section 15.0400,CR-3 Single -Family Residence Zone,Article
19 Planned Development Zoning District, and Chapter 2,
Subdivision Regulations;and,
WHEREAS, the property is legally described as follows:
The North half of the Southeast quarter of the
Northwest quarter of the Southwest quarter of Section
27, Township 1 North, Range 8 East of the Gila and
Salt River Base and Meridian, Pinal County, Arizona;
and
WHEREAS, on January 17, 2006, the Mayor and City
Council of the City of Apache Junction approved Ordinance
No. 1256 for rezoning Case PZ-21-05, to change the zoning
district classification for the property from GR (General
Rural) to CR-3/PD (Conventional Single-family Residences by
Planned Development) by unanimous vote; and
WHEREAS, on February 28, 2006, the Planning and Zoning
Commission held a public hearing regarding the preliminary
plat for Case SD -5-05 and unanimously recommended for its
approval; and
WHEREAS, on April 4, 2006, the City Council held a
public hearing regarding the preliminary plat for Case SD-
5 -05 (Resolution #06-06) and approved said preliminary plat
and Resolution by unanimous vote; and

WHEREAS, this City Council now finds this final
subdivision plat to be in compliance with the Apache
Junction City Code,Volume II,Land Development Code,
Chapter 1,Zoning Ordinance,Section 15.0400, Single-family
Residence Zone and Article 19 Planned Development Zoning
District, Chapter 2,Subdivision Regulations,and Ordinance
No. 1256 which approved the planned development concept
plan for the property.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City
Council of the City of Apache Junction, Arizona, that:
The final subdivision plat for "Vista Meadows" subdivision
is approved, subject to the following conditions:
1) The final plat mylar drawing shall not be recorded
until the developer submits to the city's Development
Services Department, the Arizona Department of
Environmental Quality Certificate of Approval to
Construct Sewer Facilities.
2) The final plat mylar drawing shall not be recorded
until the developer submits to the city's Development
Services Department an assurance bond for necessary
public improvements, in an amount to be determined by
the City Engineer.
PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION, ARIZONA, THIS 5TH DAY OF
SEPTEMBER , 2006.
