A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF
THE CITY OF APACHE JUNCTION, ARIZONA, APPROVING
A FINAL PLAT FOR "BROADWAY SAN MARCOS", A
RESIDENTIAL SINGLE-FAMILY SUBDIVISION, IN CASE
SD -5-04, BY BILL O'BRIEN REPRESENTING REPUBLIC
HOMES.
WHEREAS, the sub -divider in Case SD -5-04 proposes to
subdivide Pinal County Assessor Parcel Number 101-16-001B,
11.08 gross acres, into 84 residential lots pursuant to
Arizona Revised Statutes ("A.R.S.") Title 9, Chapter 4,
Article 6.2, and the Apache Junction City Code,Volume II,
Land Development Code,Chapter 1,Zoning Ordinance,Section
15.0400,CR-3 Single Family Residence Zone,Article 19
Planned Development Zoning District, and Chapter 2,
Subdivision Regulations;and the property is legally
described as:
The East 536.76 feet of the East half of the
Southeast quarter of the Southwest quarter of
Section 20, Township 1 North, Range 8 East of
the Gila and Salt River Base and Meridian, Pinal
County, Arizona, Except the South 50' per fee
number 2004-010331, Except any portion thereof
lying within Apache Ho Unit One, a subdivision
recorded in Book 9, Page 59 of Maps, Records of
Pinal County, more specifically described in
Case PZ-14-04; and
WHEREAS, on December 7, 2004, the Mayor and City
Council of the City of Apache Junction approved Ordinance
No. 1220, for rezoning Case PZ-14-04, to change the zoning
district classification from CR-5 ("Multiple -Family
Residence Zone") to CR-3/PD ("Single -Family Residence Zone
through Planned Development") for the property by a vote of
7 to 0; and
WHEREAS, on May 24, 2005, the Planning and Zoning
Commission held a public hearing regarding the preliminary
plat for Case SD -5-04 and recommended approval by a vote of
4 to 2; and
WHEREAS, on June 21, 2005, the Mayor and City Council
of the City of Apache Junction approved Resolution No. 05-
18, finding the preliminary subdivision plat to be in
compliance with the Apache Junction City Code,Volume II,
Land Development Code,Chapter 1,Zoning Ordinance,Section

15.0400,CR-3 Single Family Residence Zone,Article 19
Planned Development Zoning District; and Chapter 2,
Subdivision Regulations;and Ordinance No. 1220, authorizing
the preliminary plat for the property; and
WHEREAS, on August 15, 2006, the City Council approved
Case PZ-8-06, pertaining to an appeal of the City's
Landscaping and Screening Requirements.Applicants appealed
Section 6-1-6 Site Organization and Development,letter C,
Miscellaneous Design Standards,number 4, to be relieved
from the requirement to relocate existing above ground
utilities underground in exchange for providing a 1200
square foot clubhouse within the subdivision; and
WHEREAS, the City Council finds this final subdivision
plat to be in compliance with the Apache Junction City Code,
Volume II,Land Development Code,Chapter 1,Zoning
Ordinance,Section 15.0400,CR-3 Single -Family Residence
Zone,Article 19 Planned Development Zoning District; and
Chapter 2,Subdivision Regulations;and Ordinance No. 1220.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City
Council of the City of Apache Junction, Arizona, that;
1) The final subdivision plat for Broadway San
Marcos is approved.
2) Staff is directed pursuant to A.R.S. 9-463.01(J)
to record the final plat with the Pinal County
Recorder and collect the final plat recording
fee from the sub -divider and remit such amount
to the Pinal County Recorder.

OF APACHE JUNCTION, ARIZONA, THIS 19TH DAY OF SEPTEMBER ,
