HomeMy WebLinkAboutRES 06-46RESOLUTION NO. 06-46 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, APPROVING A FINAL SUBDIVISION PLAT FOR THE "CASA VILLAS SUBDIVISION", IN CASE SD -2-04, BY KARL CONOVER, REPRESENTED BY JIM MASON OF BUILDER"S ALLIANCE. WHEREAS, the subdivider in Case SD -2-04 proposes to subdivide Pinal County Assessor Parcel Numbers 102-18-004A and 102-18-005, approximately 10 gross acres, into 38 residential lots for conventional single-family homes, pursuant to Arizona Revised Statutes ("A.R.S.") Title 9, Chapter 4, Article 6.2, and pursuant to the Apache Junction City Code,Volume II,Land Development Code,Chapter 1, Zoning Ordinance,Section 15.0400,CR-3MH Single -Family Residence Zone,Article 19 Planned Development Zoning District, and Chapter 2,Subdivision Regulations;and, WHEREAS, the properties are legally described as follows: The East half of the Northeast quarter of the Northwest quarter of the Southwest quarter of Section 30, Township 1 North, Range 8 East of the Gila and Salt River Base and Meridian, Pinal County, Arizona; and The West half of the Northwest quarter of the Northeast quarter of the Southwest quarter of Section 30, Township 1 North, Range 8 East of the Gila and Salt River Base and Meridian, Pinal County, Arizona; and WHEREAS, on May 4, 2004, the Mayor and City Council of the City of Apache Junction approved Ordinance No. 1201 for rezoning Case PZ-4-04, to change the zoning district classification for the properties from GR (General Rural) and TH (Trailer Homesites) to CR-3MH/PD (Conventional or Manufactured Single-family Residences by Planned Development); and , RESOLUTION NO. 06-46 PAGE 1 OF 3 WHEREAS, on June 22, 2004, the Planning and Zoning Commission held a public hearing regarding the preliminary plat for Case SD -2-04 and unanimously recommended for its approval; and WHEREAS, on August 17, 2004, the City Council held a public hearing regarding the preliminary plat for CaseSD- 2-04 (Resolution #04-16) and approved said preliminary plat and Resolution; and WHEREAS, this City Council now finds this final subdivision plat to be in compliance with Arizona Revised Statutes ("A.R.S.") Title 9, Chapter 4, Article 6.2, and pursuant to the Apache Junction City Code,Volume II,Land Development Code,Chapter 1,Zoning Ordinance,Section 15.0400,CR-3MH Single -Family Residence Zone,Article 19 Planned Development Zoning District, and Chapter 2, Subdivision Regulations,and Ordinance No. 1201 which approved the planned development concept plan for the properties. NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction, Arizona, that: The final subdivision plat for "Casa Villas Subdivision" is approved, subject to the following conditions: 1) The final plat mylar drawing shall not be recorded until the developer submits to the city's Development Services Department, the Arizona Department of Environmental Quality Certificate of Approval to Construct Potable Water Facilities. 2) Upon compliance with Condition #1 above, Staff is directed pursuant to A.R.S. Section 9-463.01(J) to record the final plat with the Pinal County Recorder and to collect the final plat recording fee from the subdivider and remit such amount to the Pinal County Recorder.
