A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION, ARIZONA, APPROVING A FINAL
SUBDIVISION PLAT FOR THE "VILLAGE AT IRONWOOD
TOWNHOMES SUBDIVISION", IN CASE SD -2-05, BY AZIZ HELAL
OF CRESCENT MOON ENTERPRISES.
WHEREAS, the sub -divider in Case SD -2-05 proposes to
subdivide Pinal County Assessor Parcel Numbers 101-15-019
and 101-15-020, approximately 2.2 gross acres, into 29
residential townhome units, pursuant to Arizona Revised
Statutes ("A.R.S.") Title 9, Chapter 4, Article 6.2, and
pursuant to the Apache Junction City Code,Volume II,Land
Development Code,Chapter 1,Zoning Ordinance,Section
15.0600 CR-5 Multiple -Family Residence Zone,Article 19
Planned Development Zoning District, and Chapter 2,
Subdivision Regulations;and,
WHEREAS, the properties are legally described as
follows:
Lots 2 and 3 of Apache Addition Acres, according to
the plat of record in the Office of the County
Recorder of Pinal County, Arizona, recorded in Book 5
of Maps, Page 32; except the west 17 feet thereof; and
WHEREAS, on January 17, 2006, the Mayor and City
Council of the City of Apache Junction approved Ordinance
No. 1257 for rezoning Case PZ-24-05, to change the zoning
district classification for the properties from GR (General
Rural) to CR-5/PD (Multiple -family Residence Zone/
Townhouses by Planned Development); and
WHEREAS, on April 25, 2006, the Planning and Zoning
Commission held a public hearing regarding the preliminary
plat for Case SD -2-05 and recommended unanimously for its
approval; and
WHEREAS, on May 16, 2006, the City Council held a
public hearing regarding the preliminary plat for Case SD-
2 -05 (Resolution #06-15) and approved said preliminary plat
and Resolution; and

WHEREAS, this City Council now finds this final
subdivision plat to be in compliance with Arizona Revised
Statutes ("A.R.S.") Title 9, Chapter 4, Article 6.2, and
pursuant to the Apache Junction City Code,Volume II,Land
Development Code,Chapter 1,Zoning Ordinance,Section
15.0600 CR-5 Multiple -Family Residence Zone,Article 19
Planned Development Zoning District, and Chapter 2,
Subdivision Regulations,and Ordinance No. 1257 which
approved the planned development concept plan for the
properties.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City
Council of the City of Apache Junction, Arizona, that:
The final subdivision plat for "Village at Ironwood
Townhomes Subdivision" is approved, subject to the
following conditions:
1) The final plat mylar drawing shall not be recorded
until the developer submits to the city's Development
Services Department, the Certificate of 100 -year
Assured Water Supply from the Arizona Department of
Water Resources.
2) The final plat mylar drawing shall not be recorded
until the developer submits to the city's Development
Services Department an assurance bond for necessary
public improvements, in an amount to be determined by
the City Engineer.
3) The final plat mylar drawing shall not be recorded
until the developer submits to the city's Development
Services Department, the Arizona Department of
Environmental Quality Certificates of Approval to
Construct Sewer and Potable Water Facilities.
4) Upon compliance with Conditions 1, 2 and 3 above,
Staff is directed pursuant to A.R.S. Section 9-
463.01(J) to record the final plat with the Pinal
County Recorder and to collect the final plat
recording fee from the sub -divider and remit such
amount to the Pinal County Recorder.
