A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION, ARIZONA, APPROVING A FINAL
SUBDIVISION PLAT FOR THE "SUPERSTITION MOUNTAIN
ESTATES SUBDIVISION", IN CASE SD -3-05, BY TOMAHAWK 20,
LLC, REPRESENTED BY FRANK DELL'ARMI AND ROBERT
ESPOSITO.
WHEREAS, the sub -divider in Case SD -3-05 proposes to
subdivide Pinal County Assessor Parcel Numbers 100-25-006,
007, 008 and 017, approximately 20 gross acres, into 16
single-family residential lots for conventional homes,
pursuant to Arizona Revised Statutes ("A.R.S.") Title 9,
Chapter 4, Article 6.2, and pursuant to the Apache Junction
City Code,Volume II,Land Development Code,Chapter 1,
Zoning Ordinance,Section 15.1.0100 R1-43 Single -Family
Residence Zone,and Chapter 2,Subdivision Regulations;
and,
WHEREAS, the properties are legally described as
follows:
Parcel 100-25-006:The North half of the Northeast
quarter of the Northwest quarter of the Northwest
quarter of Section 15, Township 1 North, Range 8 East
of the Gila and Salt River Base and Meridian, Pinal
County, Arizona; and
Parcel 100-25-007:The North half of the Northwest
quarter of the Northwest quarter of the Northwest
quarter of Section 15, Township 1 North, Range 8 East
of the Gila and Salt River Base and Meridian, Pinal
County, Arizona; and
Parcel 100-25-008:The South half of the Northwest
quarter of the Northwest quarter of the Northwest
quarter of Section 15, Township 1 North, Range 8 East
of the Gila and Salt River Base and Meridian, Pinal
County, Arizona; and

Parcel 100-25-017:The North half of the Southwest
quarter of the Northwest quarter of the Northwest
quarter of Section 15, Township 1 North, Range 8 East
of the Gila and Salt River Base and Meridian, Pinal
County, Arizona; and
WHEREAS, on May 23, 2006, the Planning and Zoning
Commission held a public hearing regarding the preliminary
plat for Case SD -3-05 and recommended unanimously for its
approval; and
WHEREAS, on June 20, 2006, the City Council held a
public hearing regarding the preliminary plat for Case SD-
3 -05 (Resolution #06-19) and approved said preliminary plat
and Resolution; and
WHEREAS, this City Council now finds this final
subdivision plat to be in compliance with Arizona Revised
Statutes ("A.R.S.") Title 9, Chapter 4, Article 6.2, and
pursuant to the Apache Junction City Code,Volume II,Land
Development Code,Chapter 1,Zoning Ordinance,Section
15.1.0100 R1-43 Single -Family Residence Zone,and Chapter
2,Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City
Council of the City of Apache Junction, Arizona, that:
The final subdivision plat for "Superstition Mountain
Estates Subdivision" is approved, subject to the following
conditions:
1) The final plat mylar drawing shall not be recorded
until the developer submits to the city's Development
Services Department an assurance bond for necessary
public improvements, in an amount to be determined by
the City Engineer.
2) The final plat mylar drawing shall not be recorded
until the developer submits to the city's Development
Services Department, the Arizona Department of
Environmental Quality Certificate of Approval to
Construct Potable Water Facilities.

3) The final plat mylar drawing shall not be recorded
until the developer submits to the city's Development
Services Department, the improvement plans cover sheet
with all necessary signatures affixed thereto,
including approval, by signature or by separate
letter, from the Pinal County Health Department for
the use of septic tanks.
4)Upon compliance with Conditions 1, 2 and 3 above,
Staff is directed pursuant to A.R.S. Section 9-
463.01(J) to record the final plat with the Pinal
County Recorder and to collect the final plat
recording fee from the sub -divider and remit such
amount to the Pinal County Recorder.
PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION, ARIZONA; THIS 19TH DAY OF
SEPTEMBER , 2006.
